WHEREAS, the City has determined that the 10/96 Interchange Improvements must be intended to minimize the impact on residents and businesses within the Triangle Area, including the manufiletured home community known as Arden Manor; and WHEREAS, in order to move forward with the 10/96 Interchange Improvements under the environmental assessment process, the City must select a "preferred concept" for the purposes of further analysis and prcliminary design; and WHEREAS, during the preliminary design phase and the environmental assessment process, the preferred concept will be analyzed ftlr various impacts, including noise, land use and other social and economic effects; and WHEREAS, the preferred concept will be refined and amended in response to the impact analysis, and concepts of phasing the improvements will be devcloped and studied: and WHEREAS, the preliminary design phase is expected to take approximately eight months, atter which environmental assessment ftlr the 10/96 Improvements must be approved by the City, MnDOT and the County and is subject to public hearing and review; and WHEREAS, in light of the goals expressed by the City, County and MnDOT and review of various alternative concepts, the City has determined that the concept for the 10/96 Interchange Improvements dated July 23,2007 (the "July Concept Plan") is the most reasonable starting point for preliminary design and analysis under the environmental assessment process; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills as ft)lIows: I. The City selects the July Concept Plan ftlr the 10/96 Interchange Improvements as the preferred concept ftlr the purposes of proceeding with the preliminary design phase and undertaking the environmental assessment ftlr this project. 2. City staff and consultants arc authorized to take actions necessary to move ftllward with preliminary designs and the environmental assessment process based on the July Concept Plan, subject only to the City and RRLD (the "Redeveloper") reaching agreement on Redeveloper's provision of funding ftlr such preliminary design activity prior to receipt of state and federal funds ftlr such work. 3. The Council further directs that the preliminary design process shall be guided by the principle of minimizing impacts on the Triangle Area as well as other nearby residential areas that could be affected by the improvements, EfTtlrts to minimize impacts must include development of a relocation plan to minimize thc number of relocations within the Triangle Area and maximize the opportunities for moving affected owncrs into other locations within the Triangle Area. 4. City stafj~ consultants and thc Mayor and Interim City Administrator arc authorized and directed to take all actions and execute any documents necessary to carry out the intent of this resolution,
