<br />~ <br />~HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: March 31,2008 <br /> <br />TO: Mayor & City Council <br /> <br />FROM: Meagan Beekman, Planner I <br /> <br />SUBJECT: Planning Case #: 08-005 <br />Vacation Request of Four Easements and a Right-of-Way <br />CMK Arden Holdings <br />Northwest Corner of Interstates 694 and 35W <br /> <br />Requested Action <br /> <br />Consider approving Resolution 2008-016 for the vacation of four easements and a public right- <br />of-way as part of the Final Plat for the Traverse Business Center as proposed in the March 31, <br />2008, Memo to the City Council. <br /> <br />Back2round <br /> <br />On October 29, 2007, the City of Arden Hills approved a planned unit development (PUD) <br />permit to CMK Arden Holdings (Chesapeake Companies) for the Traverse Business Center to <br />construct up to 500,000 square feet of building space at the property located in the northeast <br />comer of Interstates 35W and 694. The approval was subject to ten conditions. Condition <br />number five required the applicant to replat the property prior to the issuance of any building <br />permits. As part of the proposal to replat the property, the applicant is requesting that the City <br />vacate several easements and the right-of-way for 13th Street NE, which only serves the <br />applicant's property. The existing easements do not line up with the approved building design <br />and preliminary drainage and utility plans. Furthermore, the 13th Street NE right-of-way is <br />needed for building space on the property. <br /> <br />An easement vacation requires a public hearing before the City Council. The public hearing was <br />noticed in the Shoreview-Arden Hills Bulletin prior to this evening's meeting.
