City of Arden Hills Chapter 13 Zoning Code <br />Subd. 3 Notice of Public Hearing. <br />A. Published Notice. A notice of the time, place and purpose of Public <br />Hearing shall be published in the Official newspaper at least ten (10) days <br />prior to the day of the Hearing. <br />B. Mailed Notice. Rezoning of land, Conditional Use Permits, Interim <br />Use Permits, and Planned Unit Developments, shall require mailed notice, <br />at least ten (10) days before the day of hearing, to each owner of property <br />situated wholly or partially within three hundred fifty (350) feet of the <br />boundary of the Property on which the application requiring the Public <br />Hearing is situated. The applicant shall be responsible for providing an <br />accurate list of owners, property identification numbers, addresses and <br />phone numbers to the Zoning Administrator as certified by Ramsey <br />County or a title company, printed on address labels. The City shall be <br />responsible for mailing the notices to the land owners. <br />C. Referral to Others. The administrator shall also refer copies of the <br />application and required documentation in support thereof to other City <br />officials who have an interest therein in accordance with the required <br />administrative distribution schedule. <br />D. Record of Notice. A copy of the notice and a list of the names and <br />addresses to which the notice was sent shall be attested to by the <br />administrator and shall be made a part of the records of the proceedings. <br />E. Failure of Written Notice. The failure to give mailed notice to <br />individual property owners shall not invalidate the proceedings, provided a <br />bona fide attempt to comply with this subdivision has been made. <br />Subd. 4 Public Hearing by Planning Commission. Within sixty (60) days after the <br />date of receipt of the completed application from the landowner, by the zoning <br />administrator or the City Council's initiation of the proceedings, the Planning <br />Commission shall hold a public hearing and make a written report to the Council of <br />its findings, conclusions and recommendations, unless the Commission, upon written <br />request of the applicant, grants a time extension. The applicant or his representative <br />shall be given the opportunity to appear before the Commission to answer questions <br />or give explanations regarding the proposal. The Commission may adjourn the public <br />hearing to its next meeting, either regular or special, and may continue its study and <br />consideration of the application at meetings subsequent to the meeting at which the <br />public hearing was initially held. Upon completion of the public hearing and its study <br />and consideration of the application, the Commission shall submit its written report, <br />containing its findings, conclusions, and recommendations as to the application, to the <br />Council. <br />April 14, 2008 <br />Page 2 of 13 <br />
