<br />City of Arden Hills Chapter 13 Zoning Code <br /> <br />Subd. 5 Additional Hearings by Council. The Council may hold additional <br />hearings within thirty (30) days after the receipt of the report from the Commission. <br />If the Commission fails to make a report within sixty (60) days after receipt of the <br />application, then the Council shall hold a public hearing within thirty (30) days after <br />the expiration of said sixty (60) day period, unless the Council, upon receipt of a <br />written request from the applicant, grants an extension of time. Failure to receive a <br />report from the Commission, as herein provided, shall not invalidate the proceedings <br />or actions of the Council. <br /> <br />Subd. 6 Action by Council. The Council must take action on the application <br />within sixty (60) days following the report to it by the Commission or following a <br />hearing held by the Council. Council action may include approval, denial or referral <br />back to the Commission. Council action may include approval in whole or in part, <br />tabling for a specified period of time, or referral back to the Commission for its <br />further consideration and report to the Council within a specified period of time not to <br />exceed sixty (60) days from the date of such referral. The applicant shall be notified <br />in writing ofthe Council's action. <br /> <br />1355.02 Procedure for Actions Not Requiring Public Hearings. <br /> <br />Requests for Variances and Site Plan Reviews do not require that a public hearing be held but the <br />Planning Commission may determine that adjoining property owners should be invited to their <br />meeting to offer responses to the application, prior to action by the City. <br /> <br />Subd. 1 Placing Request on Planning Commission Agenda. Within sixty (60) days <br />after the date of receipt of the application, the Zoning Administrator shall place the <br />request on the Planning Commission Agenda. <br /> <br />Subd. 2 Referral to Others. The administrator shall also refer copies of the <br />application and required documentation in support thereof to other City officials who <br />have an interest therein in accordance with the required administrative distribution <br />schedule. <br /> <br />Subd. 3 Planning Commission Consideration. The applicant or his representative <br />shall be given the opportunity to appear before the Commission to answer questions <br />or give explanations regarding the proposal. The Commission may adjourn the <br />discussion to its next meeting, either regular or special, and may continue its study <br />and consideration of the application at meetings subsequent to the meeting at which <br />the initial discussion occurred. Upon completion of its study and consideration of the <br />application, the Commission shall submit its written report, containing its finding, <br />conclusions, and recommendations to the Council and shall be placed on the next <br />Council agenda after the application has been considered by the Commission. At <br />such meeting the Council shall consider the report of the Commission thereon. <br /> <br />Subd. 4 Council Consideration. In considering applications, the Council shall <br />consider the advice and recommendations of the Commission and may approve the <br />request if it determines that the request is permissible in accordance with the city <br /> <br />Apri114,2008 <br />Page 3 of 13 <br />
