<br />The Assistant Planner has also reviewed this application and found that the outdoor patio area <br />meets all of the City's Zoning Code requirements. The proposed patio area will not impact <br />impervious coverage or setbacks, and complies with all fence regulations. She did note that a <br />fence permit would be required to install the fence. <br /> <br />In regards to the B-2 Development Moratorium, the proposed plans do not conflict with the <br />restrictions of the moratorium, as no building expansion is being proposed. Flaherty's Arden <br />Bowl is proposing some alterations to the building face that include moving a window and exit <br />door to better accommodate the patio area. These changes will require a building pell11it, but <br />meet the requirements of the design guidelines enacted by the City Council in the B-2 District <br />and, therefore, do not require a Conditional Use Permit or Amendment. <br /> <br />City Staff is currently working on updating and recodifying the City's Liquor Ordinance; <br />however, since the CUITent ordinance permits outdoor consumption in designated patio areas, the <br />recodification is not anticipated to impact this application. As part of the recodification process, <br />City Staff is working on updating the liquor license application as well to better meet the <br />requirements of the ordinance. <br /> <br />Recommendation <br /> <br />The proposed liquor license amendment is in compliance with the City's current Liquor <br />Ordinance. The proposed patioare and building improvements meet the requirements of the <br />City's Zoning Code.
