Owner to clean up after dog. <br /> <br /> The owner of any dog shall have the responsibility for <br /> cleaning up any feces of the animal, wherever dropped <br /> thereby, and shall dispose of such feces in a sanitary <br /> manner. (Ord. No. 198, § 8, 6-27-77) <br /> Sec. 5-34. Owner to prevent nuisances. <br /> ~ <br /> The owner or custodian of any dog shall prevent the dog ' <br /> from committing in the city any act which constitutes a <br /> nuisance. It is a nuisance for any dog to habitually or <br /> frequently bark or cry at night, to frequent school grounds, <br /> parks or public beaches, to chase vehicles, to molest or <br /> annoy any person away from the property of his owner or <br /> custodian, or to damage, defile or destroy public or private <br /> property. Failure of the owner or custodian of a dog to , <br /> prevent the dog from committing such a nuisance is a <br /> violation of this chapter [or "this Code" or "this division"]. <br /> Sec. 5-35. Habitual howling and barking dogs unlaw- <br /> ful; exception; complaint; notice; warrant. ' <br /> It shall be unlawful for any person to own, keep, have in <br /> his possession, or harbor any dog which, by frequent and <br /> habitual howling, yelping, barking or otherwise shall cause <br /> serious annoyance or disturbance to persons or to the <br /> neighborhood, provided that the provisions of this section <br /> shall not apply to duly authorized hospitals or clinics <br /> conducted for the treatment of small animals. No person <br /> shall be convicted under the provisions of this section <br /> except upon evidence of two (2) or more adult persons, each <br /> of a different household, and no warrant shall be issued <br /> except after five (5) days' written notice has been mailed or <br /> delivered to the occupant of the premises where such dog is <br /> kept or harbored, advising that a complaint has been made <br /> about the dog and calling attention to the provisions of this <br /> section, and provided the complaint has not been withdrawn <br /> by either party.
