<br /> <br /> i <br /> <br /> <br /> § 5-2 AftDEN HILLS CODE <br /> <br /> Secs. 5-2-5-30. R,eserved. <br /> ARTICLE II. DOGS* ` <br /> <br /> DIVISION 1. GENERALLY <br /> <br /> Sec. 5-31. Definitions. <br /> g: The following definitions shall be used in the application <br /> and interpretation of the provisions of this article: <br /> (a) Dog shall mean any species of the Canis genus of <br /> animals. <br /> (b) Kennel shall mean any establishment where dogs are <br /> kept for the purposes of breeding or sale, or sporting <br /> purposes. Any person owning, harboring or keeping <br /> for pleasure or profit three (3) or more dogs older than <br /> six (6) months shall be deemed an operator of a dog <br /> kennel. <br /> (c) Owner shall mean any person, firm or corporation <br /> ~ owning, harboring or keeping a dog. (Ord. No. 198, § <br /> 1, 6-27-77) <br /> Sec. 5-32. Running at large; control. <br /> <br /> No owner or keeper of any dog, whether licensed or <br /> unlicensed, shall permit such dog to run at large. Any dog <br /> shall be deemed to be running at large unless such dog is <br /> accompanied in close proximity by its owner and under such <br /> effective direction, supervision and control of its owner as to <br /> be in fact restrained by such owner at all times; provided, <br /> however, that during all times that any dog remaina on his <br /> owner's premises the dog shall be deemed to be within the <br /> effective direction, supervision and control of said owner. <br /> The fact that a dog is running at large within the meaning <br /> of this section shall be prima facie proof of a violation <br /> hereof, and shall subject the owner or keeper of such dog to <br /> the penalty provided in section 5-39.
