The deposition of more than four hun- <br /> dred (400) cubic yards of sand, gravel, or other earth mate- <br /> rials per single parcel or per acre, whichever is greater, on <br /> a site in such a manner as to elevate the grade. <br /> (b) Mining. The extraction of more than four hundred (400) <br /> cubic yards of sand, gravel, or other earth material from a <br /> single parcel or per acre of land, whichever is greater, in <br /> such a manner as to reduce the grade. Violations and penalties. <br /> <br /> (a) Violation of this chapter shall be a misdemeanor and <br /> upon conviction thereof ahall be punishable as provided in <br /> section 1-10 of this Code. <br /> (b) In the event of a violation or a threatened violation of <br /> ~ this chapter, the council, or any member thereof, in addition <br /> to other remedies, may institute appropriate actions or <br /> proceedings to prevent, restrain, correct, or abate such <br /> violations or threatened violations and it ia the duty of the <br /> I attorney to institute such action. Conflicts. <br /> This chapter shall supersede the zoning ordinance to the <br /> egtent that this chapter is specifically in conflict with the <br /> zoning ordinance. This chapter shall not superaede the <br /> provisions of this Code relating to sanitary landfill, since it <br /> is not intended that this chapter ahall apply to sanitary <br /> landfill as defined in section 11-2, but, eacept with respect to <br /> sanitary landfill, this chapter ahall superaede wherever <br /> there is a conflict.
