It <br /> shall be unlawful for any peraon to remove, atore, or <br /> excavate rock, sand, dirt, gravel, clay or other material <br /> within the city without obtaining a special use permit as <br /> provided herein. Exception. <br /> A permit required by the provisions of this article shall <br /> not be required for the following: <br /> (a) The excavation, removal or storage of rock, sand, dirt, <br /> gravel, clay or other material preparatory to conatruc- <br /> tion of a building thereon pursuant to a duly issued <br /> building permit; <br /> (b) Moving dirt for construction of roada or to provide for <br /> surface water drainage as provided on an approved <br /> plat, or moving dirt for landscaping purposes on a lot <br /> already occupied by a residential atructure; <br /> (c) Excavation or dirt removal incidental to conatruction <br /> of sewer and water mains, highway construction or <br /> other public projects; <br /> (d) Minor agricultural, conservation items, and sod <br /> removal. Application. <br /> (a) The application for the permit required by the <br /> provisions of this article shall be filed with the clerk-admin- <br /> istrator. Payment of the required fee shall accompany each <br /> application. Applications ahall be reviewed by the adminis- <br /> trator and referred to the engineer or attorney if deemed <br /> necessary. A minimum of forty-five (45) days ahall be <br /> considered reasonable for review before the public hearing. <br /> (b) The application and accompanying materials ahall <br /> provide the following information. <br /> (1) Purpose: The purpose of the removal, storage or <br /> egcavation and the estimated time required to <br /> complete the operationa. <br /> I 467 <br />
