<br /> <br /> <br /> <br /> § 13.5-7 AR,DEN HILIS CODE <br /> <br /> (d) Appeal by Aggrieved Applicant. In the event an <br /> applicant has been advised by the clerk-adnninistrator, <br /> pursuant to the previous subsection of this section, that his <br /> application has been denied, he shall have ten (10) days to <br /> appeal the denial to the city council. In the event he does <br /> not timely file his notice of appeal with the clerk-adminis- <br /> trator by the end of said 10-day period, he shall no longer <br /> be entitled to appeal, his appeal right having been waived. <br /> (e) Council Procedure. When a notice of appeal has been <br /> properly and timely filed with the clerk-administrator, the <br /> city council shall conaider the aggrieved applicant's appeal <br /> at a council meeting within the negt thirty (30) days of the <br /> date of the notice's filing. The purpose of the hearing shall <br /> be limited to the question of whether the clerk-administrator <br /> had sufficient grounds to deny the application under <br /> ' subsections (a) and (b) of thia section. Based upon the facts <br /> adduced at the hearing, the council ahall either affirm the <br /> decision of the clerk-administrator denying the license <br /> application or remand to the clerk-administrator for further <br /> investigation and report back to the city council within no <br /> more than forty-five (45) days from the date of the council <br /> meeting in the case of an application for a businesa license <br /> and thirty (30) days in the case of an application for a <br /> personal service license. (Ord. No. 210, § 7, 10-29-79) <br /> Sec. 13.5-8. Grant or denial of licenses. <br /> (a) Business License. <br /> (1) Notices of hearing. In the case of an application for a <br /> businesa license, the clerk-administrator shall sched- <br /> ule a public hearing thereon no later than sigty (60) <br /> days after hia receipt of the application and accompa- <br /> nying documentation. The clerk-administrator shall <br /> cause to be published in the official newspaper of the <br /> city at least thirty (30) days but not more than <br /> forty-five (45) days prior to the date of the public <br /> hearing a notice describing the nature of the business <br /> proposing to be licensed and its location and setting <br /> forth the date, time, place and purpose of the hearing. <br /> , <br /> Supp. No. 2 784 <br /> 1 <br /> _ I <br />
