<br /> <br /> <br /> <br /> § 21-12 ARDEN HILLS CODE <br /> <br /> Sec. 21-12. Same-Special use permits. <br /> For signs requiring a special use permit, the special use <br /> permit procedure described iri the Zoning Ordinance <br /> [Appendix A of this Code] of the City of Arden Hills shall be <br /> followed. (Ord. No. 216, § 8(B), 12-8-80) <br /> Sec. 21-13. Variances. <br /> In order to provide additional flexibility in the enforce- <br /> ment of this chapter and to alleviate hardship and injustice, <br /> the city council may grant variances from the dimensional <br /> requirements of this chapter. Upon application from the <br /> person seeking a permit for the erection or installation of a <br /> ~ sign, the request for variance shall be processed in <br /> accordance with applicable provisions of Arden Hills Zoning <br /> Ordinance [Appendix A of this Code], as amended. Such <br /> variance shall require a finding of fact that an undue <br /> hardship exists if the chapter were strictly enforced and <br /> shall be based upon the following considerations: <br /> (a) That the hardship is attributable to the particular <br /> physical surroundings, topographical conditions or <br /> shape of the specific parcel of land involved; or <br /> (b) That the granting of the variance would not be <br /> materially detrimental to the public welfare or <br /> injurious to the property or improvements in the <br /> vicinity or zone in which the property is located. (Ord. <br /> No. 216, § S(C), 12-8-80) <br /> Sec. 21-14. Nonconforming signs. <br /> (a) Any nonconforming temporary or portable sign <br /> existing at the time of adoption of this chapter shall be <br /> made to comply with the requirements set forth herein or <br /> shall be removed within sixty (60) days after the adoption of <br /> this chapter. <br /> (b) Nonconforming permanent signs lawfully existing at <br /> the time of adoption of this chapter shall be allowed to <br /> continue in use, but shall not be rebuilt, altered other than <br /> to change the message, or relocated without being brought <br /> Supp. No. 3 <br /> 1236 <br />
