<br /> <br /> <br /> <br /> SUBDIVISIONS § 22-4 <br /> <br /> the division of a parcel of land in such manner that any of <br /> the resultant parcels have less than twenty (20) feet thereof <br /> abutting on a public right-of-way. The term "subdivision" <br /> includes resubdivision and, when appropriate to the context, <br /> shall apply to the process of subdividing or to the land <br /> subdivided. <br /> The acquisition of land by any means for purposes of <br /> erecting or installing utility lines, including underground <br /> gas lines, overhead power lines, transmitting towers, or <br /> similar utility sites, or easements shall be considered a <br /> subdivision when such utilities are designed to serve more <br /> than one lot. (Ord. No. 98, § 4, 3-27-67) <br /> Sec. 22-4. Procedure. <br /> (a) Preliminary plan: <br /> (1) Before dividing any tract of land into two-(2) or more <br /> lots or parcels, an owner or subdivider ahall, unless a <br /> variance is authorized, irile with the clerk-administra- <br /> tor: <br /> a. Four (4) copies of the preliminary plan. <br /> y b. Such lump sum fee in cash for the entire <br /> subdivision, plus such cash fee for each lot in the <br /> subdivision, as have been established in a <br /> resolution adopted by the council. This fee will be <br /> used for expenses of the city in connection with <br /> approval or disapproval of said plan and any <br /> final plat which may thereafter be submitted. <br /> c. If the subdivider requeats that any esisting <br /> special assessments which have been levied <br /> against the premises described in the subdivision <br /> be divided and allocated to the reapective lots in <br /> the subdivision plat, the clerk-administrator shall <br /> estimate the clerical coat of preparing the revised <br /> assessment roll, filing the same with the county <br /> auditor, and making such division and allocation, <br /> and upon approval by the council of such <br /> estimated coat the same shall be paid to the city <br /> Supp. No. 3 1279 <br /> f <br /> <br /> <br /> _ J <br />
