<br /> <br /> <br /> <br /> § 28-157 ARDEN HILLS CODE <br /> <br /> Sec. 28-157. Application for proposed installation. <br /> All proposed utility inatallations in the city shall be <br /> submitted to the city for approval prior to such installation; <br /> provided however, repairs or extensions by a utility <br /> company covering less than twelve hundred (1200) feet of <br /> line, as recited in section 28-155 hereof, need not be <br /> submitted. The clerk-administrator shall require the appli- <br /> cant to furniah in writing information relative to the <br /> location of the proposed installation, the manner of its <br /> construction, whether underground or overhead, and satis- <br /> factory evidence that the consent of all affected property <br /> owners has been obtained. The clerk-administrator shall <br /> then refer the proposal to the utility committee, herein <br /> established. (Ord. No. 145, § 5.0, 6-14-71) <br /> Sec. 28-168. Action by utility committee. <br /> The utility committee shall consist of the city engineer, a <br /> planning commission member or public works committee <br /> member appointed by the council, and the city building <br /> inspector. Said committee shall review utility proposals upon <br /> the basis of the principles set forth in this article and <br /> promptly submit its report to the council thereon, advising <br /> ' the council whether, on the basis of the principles stated <br /> herein, the proposed installation should be approved. If the <br /> utility committee is of the opinion that underground <br /> installation of the proposed utilities should not be required <br /> on the basis of the standards set forth in section 28-159 <br /> hereof, it shall so recommend to the council. Recommenda- <br /> tions of the utility committee shall be by at least two (2) of <br /> the three (3) membera thereof. (Ord. No. 145, § 5.0, 6-14-71) <br /> Sec. 28-159. Ezceptions. <br /> (a) The provisiona of this article may be waived by the <br /> city council upon recommendation to that effect by the <br /> utility committee and upon the finding of the council that <br /> either or both of the following are applicable in case of the <br /> particular application: <br /> 1680 <br />
