<br /> <br /> <br /> <br /> UTILITIES § 28-156 <br /> <br /> plat or site plan approval, a written statement from the <br /> utility companies stating that the necessary arrangements <br /> for underground installation of utilities have been made. It <br /> shall be the responsibility of the developer and all contracta <br /> on the construction to keep utility easements free and clear, <br /> to the end that the utility company shall have access at all <br /> times for installation and maintenance of its utilities. (Ord. <br /> No. 145, § 3.1, 6-14-71) <br /> Sec. 28-155. Egisting distribution lines. <br /> It shall be the policy of the city to pursue the objective of <br /> eventually having all utility distribution lines underground. <br /> It is recognized, however, that existing overhead utility lines <br /> represent a substantial economic investment for the benefit <br /> of the public and that it is generally not feasible or desirable <br /> to replace existing serviceable facilities with underground <br /> lines or to require that the normal periodic egtenaions of <br /> existing overhead systems be installed underground without <br /> imposing an undue burden on the public and the utility <br /> involved. Any utility company replacing or making exten- <br /> sions to existing overhead distribution facilities in any area <br /> in which the repairs or extensions cover more than twelve <br /> hundred (1,200) feet of line shall submit its plans to the <br /> utility committee at least thirty (30) days prior to such <br /> replacement, alteration or installation. Egcavation. <br /> In order to avoid poasible damage to underground <br /> utilities, no person shall excavate in any easement or <br /> right-of-way containing underground utilities without first <br /> notifying the utility company whose lines occupy the <br /> easement or right-of-way; provided however, such egcava- <br /> tion shall not constitute a breach of this article uiRless the <br /> excavator has actual notice of the existence of the utilities <br /> or unless the easement has been recorded with the register <br /> of deeds of the county with reference to the property.
