<br />									 	ORDINANCE NO. 163
<br />		    	.						AN ORDINANCE REGULATING AND LICENSING
<br />   	~						   	THE  HANDLING,  STORING,  PREPARING,  AND
<br />							   	OFFERING   	FOR   	SALE   	OF   	GROCERIES,
<br />							   	VEGETABLES,  FRUITS,  MILK  AND  DAIRY
<br />							   	PROOUCTS, BAKERY GOODS, CANDY AND MEATS,
<br />							   	WHETHER RETAIL OR WHOLESALE, INCLUDING SALE THEREOF BY ITINERANT VENDORS, AND
<br />							   	PROVIDING PENALTIES FOR VIOLATION.
<br />							    	The Village Council of the Village of Arden Hills does
<br />							   	hereby ordain as follows:
<br />							    	Section 1. Definitions. The word "person" as used in
<br />							   	This Ordinance shall include any anq all individuals, firms, associations, or corporaTions. The word "food"
<br />			 	,				   	shall include iTems prepared or held for sale for human	     	.
<br />							   	consumpfion  as  specifically  mentionetl  in  the  title
<br />							   	hereof or elsewhere in ihis Ordinance, buT excluding malf  beverages,  intoxicating  liquors,  soft  drinks,
<br />							   	cigarettes, or oTher items similar ihereta if the same
<br />							   	are specifically covered by oTher regulatory and - or
<br />							   	licensing ordinances of ihis Village.
<br />							    	Section Y. License Required. No person shall sell or	     	"
<br />							   	offer for sale, whether aT retail or wholesale, food in						  	,
<br />							   	Arden Hills without first obTaining license as provided
<br />							   	herein.  Food  iTems covered  herein  include, without
<br />							   	limitation, groceries, vegetables, fruits, milk, dairy
<br />							   	producis,  bakery  goads,  candy,  and  meats,  but
<br />							   	resTauranis and the like duly licensetl under oTher or-
<br />							   	dinances of ihis Village shall not be required to obtain
<br />					.	   	'		 	IicensesunderihisOrdinanceforihesaleoffood. Section 3. License Application and Investigation. Any
<br />							   	person desiring a I icense To sell food hereuntler shal I file
<br />							   	an applicaTion Therefor with the Clerk - Administrator.	    	.
<br />							   	Such applicaTion shall contain the name and place of
<br />				.				   	residence of the applicant, the nature of his business,
<br />							   	the place where he carrys on said business or proposes
<br />							   	fo carry it on, the owner of the sublect premises and
<br />							   	residence of the owner.  In addition such applicaTion  _
<br />							   	shall  include  such  other  information  as  may  be
<br />							   	reasonably required by the Clerk - Adminisirator To
<br />							   	effectively carry out the provisions hereof. Such ap-
<br />							   	plication shall be referred fa the HealTh Officer, who
<br />							   	shall make such investigation as he deems necessary
<br />							   	and endorse on the application his approval or disap-
<br />							   	proval with reference particularly To the saniTary and
<br />							   	healthful condiTion of the proposed place of business and
<br />							   	the manner in which such business is proposed To be
<br />							   	operated or has been operated in the past. Upon ap-
<br />							   	proval by the Council a license may then be issued by
<br />							   	the Clerk - AdminiSTrator.
<br />							    	Section  a.  Conditions  of  Operation.  Licensees
<br />							   	hereunder must maintain iheir operation in clean and
<br />							  	sanitary condition at all times and in full conformance				     	_
<br />							  	with all applicable requiremenTS of the State of Min-
<br />							  	nesota or agencies ihereof. Licensetl establishmenis
<br />							   	musT be open for inspecfion by the Healih Officer and
<br />							  	other agenis or representatives of the Village at all
<br />							  	reasonable  times  to  insure  healthful  and  saniTary
<br />							  	operaTion of the licensed establishment. V iolation of any
<br />							  	of the provisions hereof shall be cause for cancellation
<br />							  	of the license, in addition to oTher penalties provided				    	-
<br />							  	herein, but unless the Council, upon recommendation of
<br />							  	the HealTh Officer, deems ihaT immetliate cancellaTion
<br />							  	is required for the public good, reasonable notice of
<br />		     	.				    	inTenf fo cancel shall be given the holder of the license
<br />							  	and the licensee shall be given a public hearing before
<br />							  	the Council.
<br />							    	Section S. License Fees. The following license fees are
<br />							  	established for sale oi partiCUlar food iTems. HereafTer
<br />							   	license fees for licensees hereunder shall be contained
<br />							  	in the Table of License Fees (now Ortl. No. 151), as the
<br />							  	same may be amended, and reference should be made
<br />							  	ihereto for current fees.  The license fees  provided
<br />							  	herein shall not be cumulative; That is, for example, a
<br />							  	retail grocery license hereunder shall noT be required to
<br />							  	obTain additional license fees under ihis ordinance for
<br />							  	the oTher items covered in the following Table, and
<br />							  	unless specifically indicated to the contrary, no more
<br />							  	than one license tee shall be charged for the particular
<br />							  	iTem. Also, retail groceries are not required To obtain a
<br />							  	license for soft drinks sold other Than through a vending
<br />							  	machine. The fees are graduaTed on the basis of the
<br />							  	apparent  regulatory problems  involved,  in the best
<br />							  	iudgment of the Council.
<br />							    	(a) Bakery - $25.
<br />							    	(b) Caterers - $25.
<br />							    	(c) Ifinerant food vendors, induding popcorn and ice
<br />							  	cream vendors - $25.									_
<br />							    	(d) Milk: Pasteurizing Plant - $100.
<br />							     	Secondary Vendors - $25.
<br />							    	(3) Retail Candy - $25.
<br />							    	(f) ReTail grocery - $50. (g) Retail meaT, including meat locker planis - 825.
<br />							    	(h) Wholesale foods - $50.
<br />							   	Section 6.  Penalties.  In addition to possible can- cellation of a license issued hereunder, any violation of
<br />   	•			     	'		    	ihis  Ordinance  shail  be  deemed  a  misdemeanor
<br />							  	punishable by a fine of not more ihan 8300 and - or 90
<br />							  	days in iail.
<br />							   	Section 7. Effective Date. This ordinance shall be in
<br />							  	effect and in full force frOm and after January 1, 1973,
<br />							  	buT not before its passage and publication.
