<br />							  	AN ORDINANCE REGULATING AND LICENSING  ,
<br />							 	THE  HANDLING,  STORING,  PREPARING,  AND
<br />							 	OFFERING  -FOR   	SALE   	OF   	GROCERIES,
<br />							 	VEGETABLES,  FRUITS,  MILK  AND  DAIRY				-
<br />							 	PRODUCTS, BAKERY GOODS, CANDY AND MEATS,
<br />							 	WHETHER RETAIL OR WHOLESALE, INCLUDING
<br />							 	SALE THEREOF BY -ITINERANT VENDORS, AND
<br />							 	PROVIDING PENALTIES FOR VIOLATION.
<br />							  	The Village Council of the Village of Artlen Hills does
<br />							 	hereby ordain as follows:
<br />							  	Seciion 1. De}initions. The word "person" as used in
<br />							 	this Ordinance shall include any and all individuals,
<br />							 	firms, associa}ions, or corporaTions. The word "food"
<br />   	~						 	shall include iTems prepared or held for sale for human
<br />							 	consumpiion  as  specifically  menTioned  in  the  title  .
<br />							 	hereof or elsewhere in this Ordinance, but excluding
<br />							 	malt  beverages,  intoXicating  liqu0rs,  soft  drinks,
<br />							 	cigarettes, or other items similar thereto if the same
<br />							 	are specificallY covered bY other regulatory and - or
<br />							 	liCensing ordinances of ihis Villege.
<br />							  	Sectiun 2. license Required. No person shall sell or
<br />							 	offer for sale, whether at retail or wholesale, food in
<br />							 	Arden Hills wiThout first obtaining license as provided
<br />							 	herein.  Food  items covered herein include, without
<br />							 	limitation, groceries, vegetables, fruits, milk, dairy
<br />							 	producis,  bakery  goods,  candy,  andmeeTS,  but
<br />							 	resfauran}s and the like duly licensed under other or-
<br />							 	dinances of this Village shall noY be required to obTain
<br />							 	1 icenses under th is Ordi nance for ihe sa le of food.
<br />							  	SecTion 3. License Application antl Investigation. Any
<br />							 	person desiring a license to sell food hereunder shall file
<br />							 	an application iherefor with the Clerk - AdminisTraTOr.
<br />							 	Such application shall contain the neme and place of
<br />							 	residence of the applicant, the nature of his business,
<br />							 	the place where he carrys on said business or proposes
<br />							 	to carry it on, the owner of the subject premises and
<br />							 	residence of the owner. In addiTion such applicaTion
<br />							 	shall  include  such  other  information  a5  may  be
<br />							 	reasonably required by the Clerk - Administrator to
<br />							 	effecTively carry- ouT the provisions hereof.-Such ap-
<br />							 	plication shall be referred to the HealTh Officer,who
<br />							 	shall make such investigation 8s he deems necessary
<br />							 	and enilorse on the applicaTion his approval or disap-
<br />							 	proval wiTh reference particularly To the sanitary and
<br />							 	healihful condition of the proposed place of business and
<br />							 	the manner in which such business is proposed Tn be
<br />							 	operaTed or has been operated in the Aast. Upon ap-
<br />							 	proval by the Council a license may Then be issuedby the Clerk - Adminisirator. Section  4.  Contlitions  of  Operation.  Licensees
<br />							 	hereunder musTmaintain their opereTion in clean antl
<br />							 	sanitary contlition at all times and in full conformence
<br />							 	with all applicable requiremenYS of the Stete of Min-
<br />							 	nesota or agencies thereof. Licensed establishmenis
<br />							 	must be open for inspection by the HeaNh Officer and
<br />							 	oTher agenis or represenTaTives W the Village at all
<br />							 	reasonable  times  Toinsure  healThful  and  sanitary
<br />							 	operation of the Iicensed esTablishmenT. Violation of any
<br />			 	-				 	of the provisions hereof shall be cause for cancellation ot the license, in addifion to other penalties provided
<br />							 	herein, but unless the Council, upon recommendation oP
<br />							 	the Healih Officer, deems that immediate cancellation

<br />							  	in the Table of Licmnse Fees (now-EWd, Ido. 151),-eaAAs-
<br />							  	same may be amended, and reference should he made
<br />							  	ihereto for current.fees.  The license fees  pYOVided     	.
<br />							  	herein shall noT be cumulative; ihaT is, for example, a
<br />							  	retail grocery license hereunder shall not be required to
<br />							  	obtain addiTionallicense fees under This ordinance for
<br />							  	the oTher items covered in the following Table, and
<br />							  	unless specifically indicated to the conirary, no more
<br />							  	than ane license fee shall be charged for the particular
<br />							  	item. Also, retail groceries are not required to obtain a
<br />							  	license for soft drinks sold other than through a vending
<br />							  	machine. The fees are graduated on the basis of the
<br />							  	apparent regulatory pro6lems involved, in the best.
<br />							  	judgment of the Council.
<br />							   	(a) Bakery - $25.						    	-
<br />							   	(b) Caterers - 825.
<br />							   	(c)ItineranTfood vendors,including popcorn and ice
<br />							  	cream vendors - $25.
<br />							   	(d) Milk: PaSTeurizing Plant - 8100. Secondary Vendors - $25.	    	.
<br />							   	(3) RetaiV Candy - $45.
<br />							   	(f) Retail grocery - 550.
<br />							   	(g) Retail meat,including meatlocker plants - 825.
<br />							   	(h) Wholesale foods - $50.	     	-
<br />							   	- Sectiun 6.  Penalties.  In  atldition to possible can-
<br />							  	cellation o( a-license issued hereunder, any violation of
<br />							  	This  Ordinance  shall  be  deemed  a  mistlemeanor
<br />							  	punishable by a fineof not more than 5300 and - or 90
<br />							  	days in lail.
<br />							   	5ection 7. Effecfive Date. This ordinance shall be in
<br />							  	effecT and in full force from and afTer January l, 1973,
<br />							  	buT not before its passage and publicaTion.
