~ ORDINANCE NO. 155 STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILL5 AN ORDINANCE AMENDING ORD. NO. 98, THE SUBDIVISION AND PLATTING ORDINANCE, TO ADD A PROVISION EXEMPTING CERTAIN SUB- DNISIONS. The Council of the Village of Arden Hills does hereby ordain as follows: Section 1 Amending Provision. Ord. No. 98, regulating the subdivision and platting of land in the Village of Arden Hills, is hereby amended in the following respecTS: 1. The capTion of SecTion 13 is hereby amended To reed "Variances and Exemptions." II. The following is added as Paragraph (D) of said SecTion 13: (D) In the case of a subdivision of small size and of minor imporTance, situated in a IocaliTy where con. diTions are well-defined, the Village may exempt the subdivider from complying with some of the requiremenTs of ihis ordinance. In the case of a request to divide a lot which is a parT of a recorded plat or a parcel of record prior to the effective date of this or- , dinance (April 6, 1967), where the division is To permiT the adding of a parcel of land to an abuTTing parcel or to create Two or more parcels and the newly~created property line will not cause the remaining portions of the parcel to be in violaTion of ihis ordinance or the Zoning Ordinance, the division may be approved by the Village Council. AT the opfion of the Council a survey by a registered land surveyor showing the original parcel and the proposed division shall be submilTed, but no other requiremenis of ihis ordinance shall apply. In addiTion To the foregoing exemption, exempTions from the provisions of ihis Ordinance may be granted by the Council in the instance of the division of one or more parcels as referred to in the previous paragraph into one or more separately described iracts, and exemptions may similarly be granTed from the provisions of This ordinance in insTances of the con- solidation of iwo or more parcels as aforesaid, or paris thereof, into two or more trac}s, but in the case of granting such exemptions the Council shall find com- pliance with the following condifions: 1. The owner or owners of such parcel or lots to be so divided shall file with the Administrator a proposed survey plat by a registered land surveyor of the lot or IoTS to be divided or consolidated. Such plaT or survey shall showThedimensionsof said IoTS as measured upon the recorded plaT, and also the proposed division ihereof. A wriiten description of the separately described tract or iracts which wili result from the proposed subdivision or consolidation shatl be filed wiTh such plaT or survey and 2. The separately described Tract of land to be con- veyed or designated for building permit purposes by reason of such division or consolidation as described upon said proposed plat, shall not be less ihan the minimum dimensions required To secure the minimum lot area specified in the Zoning Ordinance. 3. As a result of such division or consolidation as herein authorized, no remaining parT of an original subdivision lot or parcel shall become a separately described lot upon said proposed plaT with a size less than the minimum dimensions required to secure the minimum loT area specified in the Building and Zoning Ordinance. A filing fee of $5.00 shall be paid the Clerk- AdministraTor with every request for a variance or exempTion hereunder. Section 2 Effective Date. This ordinance shall be effecTive from and after the daTe of its passage and publication. DaTed at Arden Hills, Minnesota, this lOth day of April, 1972. Henry J.
