NO. 98, THE <br /> SUBDIVISION AND PLATTING ORDINANCE, TO <br /> ADD A PROVISION EXEMPTING CERTAIN SUB- <br /> DIVISIONS. ~ <br /> The Council of the Village of Arden Hills does hereby ~ <br /> ordain as follows: <br /> Section 1 Amending Provision. Ord. No. 98, regulating <br /> the subdivision and plaiting of land in the Village of ~ <br /> Arden Hills, is hereby amended in the following w <br /> respecis: <br /> 1. The caption of Section 13 is hereby amended to read Q~ <br /> "Variances and Exemptions." <br /> II. The following is added as Paragraph (D) of said <br /> SecTion 13: ~ <br /> (D) In the case of a subdivision of small size and of ~ <br /> minor importance, situated in a locality where con. <br /> ditions are well-defined, the Village may exempt the <br /> subdivider from complying with some of the <br /> requiremenTS of this ordinance. In the case of a request <br /> to divide a loT which is a part of a recorded plat or a <br /> parcel of record prior to the effective date of ihis or- <br /> dinance (April 6, 1967), where the division is to permiT <br /> the adding of a parcel of land to an abutting parcel or to <br /> create two or more parcels and the newly-creaTed <br /> property line will not cause the remaining portions of <br /> the parcel to be in violation of ihis ordinance or the <br /> Zoning Ordinance, thedivision may be approved by the <br /> V illage Council. AT the option of the Councit a survey by <br /> a registered land surveyor showing the original parcel <br /> and the proposed division shall be submiTTed, but no <br /> oTher requirements of ihis ordinance shall apply. <br /> In addiTion to the foregoing exemption, exemptions <br /> from the provisions of ihis Ordinance may be granted - <br /> by the Council in the instance of the division of one or <br /> more parcels as referred to in the previous paragraph <br /> into one or more separately described iracts, and <br /> exemptions may similarly be granTed from the <br /> provisions of This ordinance in instances of the con- <br /> solidation of iwo or more parcels as aforesaid, or parTs <br /> Thereof, into Two or more iracis, but in the case of <br /> granting such exemptions the Couneil shall find com- <br /> - pliance wiTh the following conditions: <br /> 1. The owner or owners of such parcel or lofs to be so <br /> divided shall file wiTh the AdminisTrator a proposed <br /> . . survey plaT by a registered land surveyor of the lot or <br /> - lots to be divided or consolidated. Such plaf or survey shal l show the dimensions of said loTs as measured upon <br /> the recorded plat, and also the proposed division <br /> Thereof. A written description of the separaTely <br /> described TracT or Tracis which wili result from the <br /> proposed subdivision or consolidation shall be filed with <br /> such plat or survey and <br /> 2. The separaTely described tracT of land to be con. <br /> veyed or designated for building permit purposes by <br /> reason of such division or consolidation as described <br /> upon said pfoposed plaT, shall noT be less than the <br /> minimum dimensions required to secure the minimum <br /> lot area specified in the Zoning Ordinance. <br /> 3, As a result of such division or consolidaTion as <br /> herein auThorized, no remaining part of an original <br /> subdivision lot or parcel shall become a separately <br /> described lot upon said proposed plat with a size less <br /> than the minimum dimensions required To secure the <br /> minimum lot area specified in the Building and Zoning <br /> Ordinance. <br /> A filing fee of $5.00 shall be paid the Clerk- <br /> Administrator with every request for a variance or <br /> exemption hereunder. . <br /> Section 2 Effective Date.
