<br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> , VILLAGE OF ARDEN HILLS <br /> ORDINANCE N0.161 <br /> AN ORDINANCE REGULATING AND LICENSING . <br /> ~ VARIOUS FORMS OF AMUSEMENTS AND COM- <br /> MERCIAL RECREATION, AND PROVIDING <br /> PENALTIES FOR VIOLATION. <br /> The Village Council of the Village of Arden Hills does <br /> hereby ordain as follows: <br /> Section 1. Purpose. I1 is the intention of the Council To <br /> . provide herein regulatory procedures covering various forms of commercial recreation in the Village of Arden <br /> Hills, to the end ihat the public welfare shall be <br /> protecTed and promoted. License fees provided herein <br /> may be varied from Time To time in the ardinance <br /> esTablishing a Tableof License Fees for the V illage, and - reference should be made to such ordinance and <br /> amendments Thereof with respect to current license fees after iheeffectivedateof ihisordinance (Ord. No. 151 as , . <br /> amended). The "businesses" proposed To be regulaTed <br /> herein are those conducted for a profiT in which fees or <br /> . charges of some kind are customarily made or are <br /> proposed to be made. <br /> Section Y. License Required. Any person or persons, <br /> company, parinership, or corporation which shall <br /> engage or propose to engage in the business of con- ' <br /> tlucfing or operating bingo games, bowling alleys, <br /> children's amusement devices (coin-operaTed, <br /> mechanical kitldy rides), dance halls, miniatuee golf <br /> courses, pinball machines, pool or billiard TAbles, roller or ice skaTing rinks, 'indoor shooting galleries, Tennis <br /> club, squash, curling or handball lanes or courts, cir- cuses or carnivals, movie iheatres or private clubs for <br /> profits shall first apply for and obtain a license . <br /> hereunder. <br /> Section 3. License Appliwtion. Applicati0n for a ' <br /> license shall be made to the Clerk-Administrator. Such <br /> application shall state the full name and address of the <br /> owner or owners of the business, the proposed locaTion . <br /> of the business, the nature of the business and such <br /> other relevanT information as the Clerk•Administrator may require for the purposes hereof. <br /> Section 4. Litense Fees. SublecT To revision hereafTer <br /> by the ordinance establishing the Table of License Fees <br /> for Arden Hills, (now Ord. No. 15]), reference To which <br /> ordinance should be made after the effective date of This <br /> ortlinance as To current license fees, the fees for the <br /> activities regulaTed herein shell be as follows: <br /> (a) Bingo - SSforeachdayofplay. <br /> (b) Bowling Alley - $10 per lane. <br /> (c) Children's amusement devices - $S (liability insurance required). <br /> (d) Dance Hall - $50. <br /> (e) Miniature Golf Course - $10. <br /> (f) Pinball machines - $10 per machine. <br /> (g) Pool antl Billiard Tables:FirsT table - $10. <br /> Each add'I table - $5. <br /> (h) Roller skating or Iceskating rink-550. <br /> (i) Indoor shooting gallery - $25. <br /> (i) Tennis Club, Curling, Squash, handball - $10 per <br /> , lane or court. <br /> (k) Movie iheatres: <br /> Less ihan 450 seats - 8100. <br /> 450 seats or more - 8300. <br /> Drive.ln - $300. <br /> Section 5. Children's Amusement Oevices - Liability <br /> Insurance Required. No license shall be issued for <br /> operation of children's amusement devices unless the <br /> applicant shall firsT obTain and file with the Village of _ <br /> Arden Hills a policy of liability insurance or a cer- <br /> Tificate of such a policy in an insurance company <br /> authorized fo do business in Minneota. The policy shall <br /> insure the applicant in the sum of E25,000 for each <br /> person; $100,000 for each accident; and $10,000 for <br /> properTy damage. The policy or certificate shall furiher <br /> provide ihat no}ice of cancellaTion ihereof shall be given <br /> the Village of Arden Hills at leasT 30 days bMare the <br /> effective date of the cancellation. Failure To keep a <br /> policy in force shall be grountls far immediate can- <br /> cellation of license. <br /> Section 6. Regulatory Provisions. Licensees <br /> hereunder musT maintain the subjecT business premises <br /> in safe and sanitary condiTion and in full compliance <br /> with all applicable federal and staTe laws and or- dinances of ihis Village. All license applications must <br /> receive the approval of the Police Depariment of Arden <br /> Hills and approval of TheCouncil of Arden Hills before <br /> issuance of the same by the Clerk-Administrator. In the <br /> event of recommendaTion to the Council for denial or <br /> cancellation oi any license hereunder the Council shall, <br /> unless immediaTe cancellation is required by pressing <br /> public interest, give the licensee or applicanT an op- <br /> portunity for public hearing before the Council with <br /> respect to the application or license. In the evenT can- <br /> cellation is necessary immediately, such cancellation <br /> shall be Temporary until the licensee is given the op- <br /> portunity for such hearing. <br /> Section 7. Penalties Provided. Any violaTion of This <br /> Ordinance shall be grounds for cancellaTion of the <br /> subiect license, if any, and shall furiher be deemed a misdemeanor punishable by a fine not more than f300 I <br /> and-or 90 days in jail. <br /> Section S. Effective Date. This ordinance shall be in <br /> effect from and after January 1, 1973, but not prior to its <br /> passage and publication. <br /> Passed by the Council of the V illage of Arden Hills This - <br /> 131h day of November, 1972. <br /> Henry J.
