<br /> <br /> ' STATE OF MINNESOTA ` . <br /> COUNTY OF RAM3EY <br /> VILLAGE OF ARDEN HILLS <br /> ORDINANCE NUMBER 68 <br /> AN ORDINANCE AMENDING ORDI- <br /> NANCE NUMBER 32, RELATING TO <br /> THE SALE OF INTOXICATING LI- <br /> QUOR, BY REDEFINING GENERAL <br /> GONSIDERATIONS AND ET.IGIBLE <br /> ON-SALF1 LICENSEES, CHANGING <br /> THE LIMITATION ON THE NUMBER <br /> OF ON-SALE LICENSES WHICH MAY <br /> BE ISSUED, AMENDING THE PRO- <br /> VISIONS RES.ATING TO HOURS OF <br /> SALE, AND REPEALING ORDINANCE <br /> NiTMBER 62 <br /> THE VILLAGE COUNCIL OF THE <br /> VILLAGE OF ARDEN HILLS DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> $ECTION 1. GENERAL CONSIDERA- <br /> TIONS PERTAINING TO "ON-SALE" ' <br /> LICENSE FEES. <br /> Subdivision 1 of Section 4 of Ordinance <br /> Number 32 is hereby amended to rea@ <br /> ~ sa foliows> to-wit: <br /> Subdivision 1. General Coneiderationa <br /> ftelating to "on sale" License Fees. <br /> The Council has determined that the <br /> licensing of "on sale" liquor eatab- <br /> lishments within the Village of Ar- <br /> den Hills imposes additional respon- <br /> sibilities and burdens on the Village <br /> with reapect to policing and super- <br /> vising of such establishments, and <br /> that it is in the interest of public <br /> welfare that license fees on such <br /> eatablishmenta should be imposed on <br /> a basis which has a direct relation <br /> to the traffic and activity in such <br /> establishments. Accordingly °on <br /> sale" liquor license fees shall be <br /> based upon gross liquor receipte <br /> in sueh establishments as hereinafter <br /> sPeeifically set forth. <br /> SECTION 2. ELIGIBILITY AND <br /> NUMBER OF ON-SALE LIQUOR LI- <br /> CENSEB IN THE VILLAGE <br /> Subdiviaion 2 of Section 2 of Ordi- <br /> nance Number 32 is hereby amended to <br /> read as followa, to-wit: <br /> "On Sale" licenaes aha11 be isaued <br /> only to hotels, clwbs and esclusive <br /> liquor stores and shall permit "bn <br /> sales" of liquor only, except as here- <br /> inafter provided. <br /> Notwithstanding the foregoing, and <br /> pursuant to the Provisions of Chap- <br /> ter 53 of the 1961 Extra Seasion <br /> Laws of the State of Minnesota, <br /> any estabtishment in the Villsge of <br /> Arc}en Hills which' holda a combina- <br /> tion "on asle" and "bff sale" li- <br /> cenae for the sale of intoxicating <br /> liquor may sell food. Accordingly in <br /> addition to the foregoing eligible <br /> licenaees, "on sale" licenses maq be <br /> iasued by the Council to a properly- <br /> qualWied applicant pmposing to <br /> serve food on the premises which are <br /> . . the subject of the. application, in . . . the event that anapplication for an . `bff sale" license at the asme estab- <br /> 'i lishment is also submitted and ia <br /> . grantedby the Council,unleas such "off sale" license has previously <br /> been granted for said establishment. <br /> For the purpose of this provision <br /> "eatablishment" ahall mean two sep- <br /> arate businesses which are located in <br /> the same building or in adjacent <br /> buildings. <br /> The Couneil may, in its @iscretion, <br /> grant "bn sale" licenses to the max- <br /> . . mber Prmitted by the laws . <br /> imum nu <br /> e <br /> . . . of the State of Minnesota. . . <br /> SECTION 3. ORDINANCE NUMBER <br /> 62 REPEALED. <br /> Ordinance Number 62, amending Ordi- <br /> nance Number 32, is hereby expressly <br /> repealed. <br /> SECTION 4. AMENDMENT RE <br /> HOURS OF SALE. <br /> Section 9 of Ordinance Number 82 <br /> is hereby amended to read as followe, <br /> to-wit : <br /> SECTION 9. Hours of Operation. No <br /> ' . . sale of intoxicating liquor shall be ma3e after 1:00 A.M. on Sunday, <br /> nor between the houra of 1:00 A.M. <br /> . and 3:00 P.M. on any Memorial <br /> Da9, nor between the hours of 1:00 <br /> . A.M. an@ 8.:00 P.M. on any Election <br /> Day. No "on sale" shall be made <br /> between the hours of 1:00 A.M. and <br /> 8:00 A.M. on any weekday. No "off <br /> sale" shall be made before 8:00 A.M. <br /> or after 8:00 P.M. of any day ex- <br /> ~ ~ cept Saturday or except the da9s <br /> preceding the holidays hereinafter <br /> ~ apecifically set forth on which days <br /> and on Saturdays "off sale° may be <br /> made until 10:00 P.M. No "off sale" <br /> shall be made on New Year's Day, <br /> Januery 1; Mexnorial Day, May <br /> 80: Indepenr}ence Day, Julq 4; <br /> Thanksgiving Day ; or Christmas <br /> Day, December 26, but "off sale" <br /> may be made until 10:00 P.M. on <br /> the evenings preceding such days, <br /> unless the sale of liquor is other- <br /> wise prohibited on such evenings, <br /> . . an@ with the exception that no "off sale" ahall lae made on December <br /> 24 after 5:00 P.M. <br /> SECTION 5. <br /> This Ordinance shal] be in effect from <br /> . and after its passage and publication. .
