<br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> VILLAGE OF ARDEN HILLS <br /> ORDINANCE NUMBER 68 <br /> AN ORDINANCE AMENDING ORDI- <br /> NANCE NUMBER 32, RELATING TO <br /> THE SALE OF INTO%ICATING LI- <br /> QUOR, BY REDEFINING GENERAL <br /> CONSIDERATIONS AND E'LIGIBLE <br /> ON-SALE LICENSEES, CHANGING <br /> THE LIMITATION ON THE NUMBER <br /> OF ON-SALE LICEN5E8 WHICH MAY <br /> BE ISSUED, AMENDING THE PRO- <br /> VISIONS RELATINQ TO HOURS OF <br /> 3ALE, AND REPEALING ORDINANCE <br /> NUMBE'R 62 <br /> THE VILLAGE GOUNCIL OF THE <br /> VILLAGE OF ARDEN HILLS DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. GENERAL CONSIDERA- <br /> TIONS PERTAINING TO "ON-SALE° <br /> LICENSD F'EES. <br /> Subdivision 1 of Seetion 4 of Ordinance <br /> Number 32 is hereby amended to rea@ <br /> ~ as follows, to-wit: <br /> Subdivision 1. General Considerations <br /> Relating to "on sale" License Fees. <br /> ~ The Counesl has determined that the <br /> licenaing of "on sale" liquor eatab- <br /> lishmenta within the Village of Ar- <br /> den Hilis imPoses additional respon- <br /> sibilities and burdens on the Village <br /> with respect to policing and swper- <br /> vising of such establishments; and <br /> that it is in the interest of Bublic <br /> welfare that license fees on such <br /> establishments should be impose8 on <br /> a basis which has a direct relation <br /> to the traffic and activity in such <br /> establishments. Accordingly "on <br /> ssle" liquor license feea ahall be <br /> based upon grosa liquor receipta <br /> in sueh establishmenta as hereinafter <br /> specifically set forth. <br /> SECTION 2. ELIGIBILITY AND <br /> NLTMBER OF ON-SALE LIQUOR LI- <br /> GENSES IN THE VILLAGE <br /> Subdivision 2 of Section 2 of Ordi- <br /> nance Number 32 is hereby amended to <br /> read as follows, to-wit: <br /> "On Sale" licenaea aha11 be iasued <br /> only to hotels, cluba and eaclusive <br /> liquor stores and ahall permit "bn <br /> sales" of liquor only, excegt as here- <br /> inafter provided. <br /> Notwithstanding the foregoing, and <br /> gursuant to the Provisions of Chap- <br /> . ter 53 of the 1961 Extra Session . Lawa of the State of Minnesota, <br /> any establiahment in the Village of <br /> Arden Hills which holds a combina- <br /> tion "bn sale" and `bff sale° li- <br /> cense for the sale of intoxicating <br /> liquor may sell food. Accordingly in <br /> addition to the foregoing eligible <br /> licenaeea, "on sale" licenses may be <br /> issued by the Council to a groperly- <br /> qualgied applicant gnoPaeing to serve food on the premises which are <br /> the subject of the application, in <br /> the event that an application Por an <br /> "bff sale" license at the same cstab- <br /> . lishment is also submitted and is <br /> granted by the Council, unless such <br /> "off sale" licenae has previously been granted for said establishment. <br /> For the purPOSe of this Arovision "establishment" shall mean two sep- <br /> arate businesses whieh are located in <br /> the same building or in ad]acent <br /> buildings. <br /> The Council may> in its diseretion, <br /> grant "on sale" licenaes to the max- . . . . ` imum number permitted by the laws . . of theState of Minnesota. SECTION 3, ORDINANCE NUMBER <br /> 62 REPEALE21. <br /> Ordinance Number 62, amending Ordi- <br /> nance Number 32, is hereby expressly <br /> rePealed. <br /> SECTION 4. AMENDMENT RE <br /> HOURS OF SALE. <br /> Section 9 of Ordinance Number 32 <br /> is hereby amended to read as follows, <br /> . . . . . to-wst• . . SECTION 9. Hours of Operation. No <br /> sale of intoxicating liquor shall be <br /> ma(le after 1:00 A.M. on Sunday, <br /> nor between the hours of 1:00 A.M. <br /> and3:00 P.M. on any Memorial . . <br /> Day, nor between the hours of 1:00 <br /> A.M. an& 8:00 P.M. on any Eleetion <br /> Day. No "on sale" shall be made <br /> between the hours of 1:00 A.M. and <br /> 8:00 A.M. on any weekday. No "bff <br /> sale" ahall be made before 8:00 A.M. <br /> ar after 8:00 P.M. of any day ex- <br /> cept Saturday or except the days <br /> ~ preceding the holidays hereinafter <br /> apecifically set fozth on which days <br /> and on Saturdays "off sale" may be <br /> made until 10:00 P.M. No "bff sale" <br /> I shall be made on New Year's Day, <br /> January 1; Memorial Day, May <br /> 30; Independence Day, duly 4; <br /> . . . . Thanksgiving . Day ; or Chriatmas . Day, December 25, but "off sale" <br /> may be made until 10:00 P.M. on <br /> . . . . the evenings preceding such days> . . . . . unless the sale of liquor is other- <br /> wise prohibited on such evenings, <br /> and with the exception that no "off <br /> - sale" shall be made on December <br /> 24 after 8:00 P.M. <br /> SECTION 5. <br /> Thia Ordinance shall be in effect from <br /> and after its passage and Fublication. <br /> PASSED BY THE VILLAGE COUN- <br /> CIL OF ARDEN AILI.S THIS 26 DAY <br /> OF NOVEMBER 1962. <br /> Robert O.
