BTATE OF MINNESOTA COUNTY OF RAMBEY VILLAGE OF ARDEN HILL3 OHDINANCE NUMBER 68 AN ORDINANCE AMENDING ORDI- NANCE NUMBER 32, RELATING TO THE SALE OF INTO%ICATING LI- QUOR, BY REDEFINING GENERAL CONSIDERATIONS AND EZIGIBLE ON-SALN7 LICENSEES, CHANGING THE LIMITATION ON THE NUMBER OF ON-SALE LICENSES WHICFI MAY BE ISBUED, AMENDING THE PRO- VI3ION5 RET.ATING TO HOURS OF SALE, AND REPEALING ORDINANCE NUMBER 62 THE ALLAIGEOF AR EN FIILLS DOE3 HEREBY ORDAIN AS FOLLOW3: SECTION 1. GENERAL CONSIDERA- TION3 PERTAINING TO "ON-SALE" ~ LICENSD FEES. Subdivision 1 of Section 4 of Ordinance Number 32 ia hereby amended to read ss follows, to-wit: Subdivision 1. General Considerations Belating to "on eale" License Feea. The Council hss determined that the licensing of "on sale" liquor estab- lishments within the Village of Ar- den Hills imposes additional respon- sibilitiea and burdena on the Village with reaBect to policing and auper- vising of such establishments, and that it is in the interest of public welfare that license feea on auch establiahmento should be imPosed on a basis which has a direet relation to the traffic and activity in such establishments. Accordingly "on sale" liquor license fees shall be based npon gross liquor receiDts in such establiahments ss hereinafter apecifically set forth. SECTION 2. ELIGIBILITY AND NUMBER OF ON-SALE LIQUOR LI- CENSES IN THE VILLAGE Subdivision 2 of Section 2 of Ordi- j nance Number 82 is hereby amended to I read as follows, W-wit: "On 5ale" licenses ahall be isaued only to hotels, clubs and eaclusive liquor stores and shall permit "on sales" of liquor only, except as hexe- inafter provided. Notwithatanding the foregoing, and pursuant to the nrovisions of Chag- ter 53 of the 1961 Extra Session Laws of the State of Minnesota, any establiahment in the Village of Ar@en Hilla which holda a combina- tion 'bn sale" and "off aale" li- cenae for the sale oP intoxicating liguor may sell faod. Accordingly in sddition to the foregoing eligible licenaees, "on sale" licenses may be issued by the Council to a properly- - gnalgied applicant pitoposinB to serve food on the premises which are the subject of the agplication, in the event that an aHPlication for an "off sale^ license at the same estab- lishment is also submitted and is granted by the Council, unleas such "off sale" licenae has previously been granted for said eatabliahment. For the purPOSe of this provision "establishment" shall mean two aep- arate businesses which are located in the same building or in adjacent buildinga The Couneil may, in its discretion, grant "on sale° licenaea to the max- unum number permitted by the Iaws of the State of Minnesota. SECTION 3. ORDINANCE NUMBER 62 REPEALED. Ordinance Number 62, amending Ordi- nance Number 32, is hereby expresely repealed. SECTION 4. AMENDMENT RE HOURS OF SALE. Seetion 9 of Ordinance Number 32 is hereby amended to read as followe, to-wit : 9ECTION 9. Honrs of Operation. No sale of intoxicating liquor ahall be made after 1:00 A.M. on Sunday, nor between the hours of 1:00 A.M. and 3:00 P.M. on any Memorial Day, nor between the hours of 1:00 A.M. and 5:00 P.M. on any Election • Day. No "on sale" shall be made between the houra of 1:00 A.M. and 8:00 A.M. on any weekday. No "off sale" shall be made before 8:00 A.M. or after 8:00 P.M. of any day ea- cent Saturday or except the dsys preceding the holidays hereinafter specifically set forth on which days and on Saturdays "bff sale° may be made until 10:00 P.M. No "off sale" ahall be made on New Year's Day, January 1; Memorisl Day, May 30 ; Independence Day, July 4; Thanksgiving Day ; or Christmas Day, December 26, but °off sale" may be made until 10:00 P.M. on the evenings preceding such days, unless the sale of liquor is other- wiae prohibited on such eveninga, an@ with the exception that no "off sale" shall be made on December 24 after 8:00 P.M. 3ECTION 5.
