<br /> <br /> BTATE OF MINNESOTA <br /> COUNTY OF RAMBEY <br /> VILLAGE OF ARDEN HILL3 <br /> OHDINANCE NUMBER 68 <br /> AN ORDINANCE AMENDING ORDI- <br /> NANCE NUMBER 32, RELATING TO <br /> THE SALE OF INTO%ICATING LI- <br /> QUOR, BY REDEFINING GENERAL <br /> CONSIDERATIONS AND EZIGIBLE <br /> ON-SALN7 LICENSEES, CHANGING <br /> THE LIMITATION ON THE NUMBER <br /> OF ON-SALE LICENSES WHICFI MAY <br /> BE ISBUED, AMENDING THE PRO- <br /> VI3ION5 RET.ATING TO HOURS OF <br /> SALE, AND REPEALING ORDINANCE <br /> NUMBER 62 <br /> THE ALLAIGEOF AR EN FIILLS DOE3 <br /> HEREBY ORDAIN AS FOLLOW3: <br /> SECTION 1. GENERAL CONSIDERA- <br /> TION3 PERTAINING TO "ON-SALE" <br /> ~ LICENSD FEES. <br /> Subdivision 1 of Section 4 of Ordinance <br /> Number 32 ia hereby amended to read <br /> ss follows, to-wit: <br /> Subdivision 1. General Considerations <br /> Belating to "on eale" License Feea. <br /> The Council hss determined that the <br /> licensing of "on sale" liquor estab- <br /> lishments within the Village of Ar- <br /> den Hills imposes additional respon- <br /> sibilitiea and burdena on the Village <br /> with reaBect to policing and auper- vising of such establishments, and <br /> that it is in the interest of public <br /> welfare that license feea on auch <br /> establiahmento should be imPosed on <br /> a basis which has a direet relation <br /> to the traffic and activity in such <br /> establishments. Accordingly "on <br /> sale" liquor license fees shall be <br /> based npon gross liquor receiDts <br /> in such establiahments ss hereinafter <br /> apecifically set forth. <br /> SECTION 2. ELIGIBILITY AND <br /> NUMBER OF ON-SALE LIQUOR LI- <br /> CENSES IN THE VILLAGE <br /> Subdivision 2 of Section 2 of Ordi- <br /> j nance Number 82 is hereby amended to <br /> I read as follows, W-wit: <br /> "On 5ale" licenses ahall be isaued <br /> only to hotels, clubs and eaclusive <br /> liquor stores and shall permit "on <br /> sales" of liquor only, except as hexe- <br /> inafter provided. <br /> Notwithatanding the foregoing, and <br /> pursuant to the nrovisions of Chag- <br /> ter 53 of the 1961 Extra Session <br /> Laws of the State of Minnesota, <br /> any establiahment in the Village of <br /> Ar@en Hilla which holda a combina- <br /> tion 'bn sale" and "off aale" li- <br /> cenae for the sale oP intoxicating <br /> liguor may sell faod. Accordingly in <br /> sddition to the foregoing eligible <br /> licenaees, "on sale" licenses may be <br /> issued by the Council to a properly- <br /> - gnalgied applicant pitoposinB to serve food on the premises which are <br /> the subject of the agplication, in <br /> the event that an aHPlication for an <br /> "off sale^ license at the same estab- <br /> lishment is also submitted and is <br /> granted by the Council, unleas such <br /> "off sale" licenae has previously <br /> been granted for said eatabliahment. <br /> For the purPOSe of this provision <br /> "establishment" shall mean two aep- <br /> arate businesses which are located in <br /> the same building or in adjacent <br /> buildinga <br /> The Couneil may, in its discretion, <br /> grant "on sale° licenaea to the max- <br /> unum number permitted by the Iaws <br /> of the State of Minnesota. <br /> SECTION 3. ORDINANCE NUMBER <br /> 62 REPEALED. <br /> Ordinance Number 62, amending Ordi- <br /> nance Number 32, is hereby expresely <br /> repealed. <br /> SECTION 4. AMENDMENT RE <br /> HOURS OF SALE. <br /> Seetion 9 of Ordinance Number 32 <br /> is hereby amended to read as followe, <br /> to-wit : <br /> 9ECTION 9. Honrs of Operation. No <br /> sale of intoxicating liquor ahall be <br /> made after 1:00 A.M. on Sunday, <br /> nor between the hours of 1:00 A.M. <br /> and 3:00 P.M. on any Memorial <br /> Day, nor between the hours of 1:00 <br /> A.M. and 5:00 P.M. on any Election <br /> • Day. No "on sale" shall be made <br /> between the houra of 1:00 A.M. and <br /> 8:00 A.M. on any weekday. No "off <br /> sale" shall be made before 8:00 A.M. <br /> or after 8:00 P.M. of any day ea- <br /> cent Saturday or except the dsys <br /> preceding the holidays hereinafter <br /> specifically set forth on which days <br /> and on Saturdays "bff sale° may be <br /> made until 10:00 P.M. No "off sale" <br /> ahall be made on New Year's Day, <br /> January 1; Memorisl Day, May <br /> 30 ; Independence Day, July 4; <br /> Thanksgiving Day ; or Christmas <br /> Day, December 26, but °off sale" <br /> may be made until 10:00 P.M. on <br /> the evenings preceding such days, <br /> unless the sale of liquor is other- <br /> wiae prohibited on such eveninga, <br /> an@ with the exception that no "off <br /> sale" shall be made on December <br /> 24 after 8:00 P.M. <br /> 3ECTION 5. <br /> This Ordinance shall be in effect from <br /> snd after ita passage and publication. <br /> PASSED BY THE VILLAGE COUN- <br /> CIL OF ARDEN HILLS THIS 26 DAY <br /> OF NOVEMBEEL 1962. <br /> Robert O.
