In addition, <br /> the Glerk-Aclministratox shall mail a <br /> similar notice at least fifteen (15) days <br /> prior to the date of the public hearir?g to <br /> each owner•of property located witYtin <br /> ,S001feet of the premises which are the <br /> ,subject of the applieation. A copy of the <br /> notice and a list of the names and <br /> addresses of the persons to whom it was <br /> sent shall be attached thereto by the <br /> Clerk-Aclministrator and shall be made a <br /> part of the records of the proceedings. <br /> The failure to give mail notice to <br /> individual property owizers sha].1 not <br /> invalidate the proceeding providing a bona <br /> fide attempt to comply with this subsection <br /> has been made. <br /> (2) Public Hearing. The City Gouncil shall <br /> conduct a public hearirag. The applicant, <br /> or his representative, shall be giaen the <br /> opportunity to appear before the City <br /> Council to present reasons why his applica- <br /> tian should be granted and to aaswer <br /> questions of the Councilmen and members of <br /> the publica A1.1 persons in favor of, <br /> opposed to, or interested in the applica- <br /> tion will be heard. The Ci,ty Council may <br /> adjourn the public hearing to its next <br /> meeting, either regular or special, and <br /> may continue its study and consideration <br /> of the application at meetings subsequent <br /> to the meeting afi which the public hearing <br /> was initially held, <br /> (3) Considerations. The City. Council shall <br /> • consider, in determininR whether to grant, <br /> eleny,, or renew a license, the <br /> effiect of the proposect establishment upon <br /> , the health, safety, convenience, morals <br /> and general welfare oiE the ovmers and <br /> occupants of surrounding progaerties in <br /> particular and the community as-a whole <br /> and at a minimum the following factors: <br /> a. The character and suitability of the <br /> area and_neighborhood in which the <br /> proposed-establishment'is to be <br /> located; <br /> be Traffic congestion and parking prob- <br /> Iems; <br /> ce Reasonably anticipated likelihood of <br /> . excessive noise, disturbances or <br /> fighting by persons in or about the <br /> proposed establishment; <br /> <br /> <br /> - 12 <br />
