No more than two (2) business <br /> licenses issued hereunder may be in force at any one <br /> time. <br /> (b) Personal Service La.cense; Masseurs and - <br /> Masseuses. No masseur nor masseuse shall perform or adaninister massages tanless he or she has a va7Lid permit <br /> ; issued pursuant to the provisions of this Ordinanceo <br /> Personal service licenses issued to masseurs or <br /> niasseuses hexeunder are not transferable. <br /> <br /> (c) Exceptions. <br /> <br /> (1) Massage Distinguished; Incidental Massage. <br /> The practice of massage is hereby declared <br /> . to'be distinct from the practice of inedi- <br /> cinle, stxrgery, osteopathic; chiropractic, <br /> physical therapy or podiatry arid persons <br /> duly licensed in this State to practice <br /> suCh disciplines, nurses who work solely <br /> under the direction of any such persons, <br /> and establishr.ients at which such discip- <br /> lines are practiced are hereby expressly <br /> excluded from the provisions of this Orrlin- <br /> ande. Massages performed incidental to <br /> athletic or physical training programs <br /> op~rated by athletic clubs, sports and. <br /> heailth clubs, public or pri.vate educa- <br /> tioinal institutions, or athletic teams, or <br /> - given by manicurists, beauty culturists, <br /> , hairdressers or barbers incidental to the <br /> beaiutification services customarily and <br /> pri;marily provided by them, and the shops, <br /> • p].aices, establisfunents or locations at <br /> which such incidental ma$sages are provided, <br /> . sh~ll likewise be exempt from the provisions <br /> of this Ordi.nance. <br /> (2) Incidental Saunas. A license shall not be <br /> required under the provisions of this <br /> Or4inance for premises on whi.ch saunas, but <br /> not massages, are provided incidental to <br /> the use of exercise and recreational equip- <br /> ment and facilities situated on the same <br /> premises provided that the sauna facilities <br /> occupy a floor area equivalent to not more <br /> than ten percent (100) of the floor area <br /> used for the exercise and recreational <br /> equipment and facilities. Likewise, no <br /> license is required hereuncler for hotels, <br /> motels, rooming houses, apartment buildings, <br /> office buildings, and condominiums in which <br /> saunas, but not massages, are provided <br /> incidental to the rental of rooms or apart- <br /> ments or the ownership thereof and the use <br /> - 3 - <br />
