STA1"E OF MINNE30TA COUNTY OF RAM3EY VILLAGE OF ARDEN HILLS ORDINANCE NO. 95 ~ AN ORDINANCE PROVIDING FOR APPOINTMENT OF A PLANNING COMMISSION AND PRESCRIBING THE POWERS AND DUTIES THERE- OF The Village Council of the Village of Arden Hills does hereby ordain as fol- ~ lows : 3ectian I: Appointment oF Planning Commisaian. At the first Counci] meet- ing after the effective date of this ordi- . nance, and thereafter at the first bus- iness meeting of the calendar year, the - Mayor shall aFPOint a Planning Commis- sion to consist of nine membera, and shall designate ane of the membera as Chairman of the Planning Commiseion. Such appointment ahall be submitted to the Council at such Council meeting and shal] became effective on approval by majority vote of the entire Council. Va- cancies on the Commission cecwrring during the calendar year ahall be filled - by the Mayor as soon as conveniently - posaible, with the approval of the ma- jority of the entire Councit. The term of each member shall be for the calendar . year or the balance thereof following his . appointxllent. - Section II. Pawera and Duties of the . Planning Cummiesion. The Planning - Commission ahall have all of the powers and duties prescribed for the ;planning agency in the Municipal Planning Act, Chapter 670 of the Laws of 1965. The Pl'anning Commission shall cansider . ~ amendments to the Zoning Ordinance, variances to the Zaning Ordinance upon reports from the Board of Appeals, such - other matters as are required to be re- . ferred ta it by the Municipal Planning Act or other statutes of the State of - ffiinnesota, and in addition thereto the Planning Commission shall consider all other matters referred to it by the Vil- iage Council. Recommendations and findings of the Planning Commission sha11 in all cases _ be advisory to the Villsge Council, whicb may take such action thereon as it deems proper. Sectiun III. Pmcedure of the Plan- ning Commissian. The Planning Com- mission shall prescribe its own rules of procedure to the extent permissible . under statute and to the extent that . such rules are consisent with village or- " dinances, The members may elect a vice chairman, a secretary, and such other officers as they ahall deem appropriate. . The Commission shall provide a written - record of its proceedinga, including the minutes of its meetings, findings, and the action taken by the Commission on _ each matter referred to it or heard by it, including the final recommendatian. - Hearing ahall be held by the G'ommis- sion in all matters where public hear- ings are required by the statutes of the State of Minnesota or the ordinances of this Village, and hearinga may be af- forded to any interested parties on any other matter where the Commission deems it appropriate. The Commission shall submit reports . directly to the Village Council, which reparts shall include the recommenda- tions of the Commission as to action - to be taken by the Cauncil. In addition thereto, the Commission shall send cop- ies of its reports on variances of the Zoning Ordinance to the Board of Ap- peals. In the absence of an adverse written recommendation by the Plan- ning Commission regarding an9 report , on the variances submitted to the Plan- ning Commission by the Board of Ap- peals, if the report of the Board of Appeals has been duly filed with the , ~ Planning Commission and the Planning . Commission has thereafter met without taking action thereon, it shall be con- clusively presumed that the Planning Commission concura in the recommend- . ation made by the Board of Appeals to the Planning Commission and to the ` Lillage Cauncil. $ectiolt IV.
