<br />~ <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />July 9, 2008 <br /> <br />TO: <br /> <br />Mayor and City Council <br />Ron Moorse, City Administrator <br /> <br />FROM: <br /> <br />Kristine Giga, Civil Engineer <br />James Lehnhoff, City Planner <br /> <br />SUBJECT: <br /> <br />Erosion and Sediment Control Ordinance and Enforcement <br /> <br />BACKGROUND <br /> <br />Ordinance #328, Erosion and Sediment Control, was adopted on July 9, 2001. Since that time, <br />regulations have changed and evolved. As part of the City of Arden Hills' Municipal Separate <br />Storm Sewer System (MS4)/ Storm Water Pollution Prevention Plan (SWPPP) permit, revisions <br />to the Erosion and Sediment Control ordinance are required. Updates to the ordinance must be <br />in place by August 15, 2008, which is six months after the permit coverage was extended to the <br />City by the Minnesota Pollution Control Agency (MPCA). <br /> <br />DISCUSSION <br /> <br />The revisions to the Erosion and Sediment Control ordinance focus on the following: <br />· Bringing the ordinance into compliance with current standards and regulations; <br />· Incorporating the MS4/SWPPP requirements; <br />· Revising and clarifying the enforcement process for staff and applicants; <br />· Enhancing the enforcement tools for the City; and, <br />· Integrating the Ordinances into the City Code as Chapter 15. <br /> <br />The revised ordinance is designed to be clearer, easier to find, and easier to enforce with a <br />broader range of tools. The ordinance will allow the City to complete corrective work if the <br />permittee fails to do so and draw on escrow or charge the permittee for all related expenses. <br />Issuing stop work orders, withholding other inspections, and withholding Certificate of <br />Occupancy have also been incorporated into the enforcement section. <br /> <br />In an effort to assist the City with inspections and enforcement of this ordinance, the Ramsey <br />Conservation District (RCD) has provided a proposal for erosion and sediment control services. <br />\ \Metro-inet.us\ardenhills\PR&PW\Engineering\2008\CounciJ _ Actions\ 7 -14-08 _Memo _ ESC _ Ordinance.doc <br />
