~ MEMORANDUM DATE: July 9, 2008 TO: Mayor and City Council Ron Moorse, City Administrator FROM: Kristine Giga, Civil Engineer James Lehnhoff, City Planner SUBJECT: Erosion and Sediment Control Ordinance and Enforcement BACKGROUND Ordinance #328, Erosion and Sediment Control, was adopted on July 9, 2001. Since that time, regulations have changed and evolved. As part of the City of Arden Hills' Municipal Separate Storm Sewer System (MS4)/ Storm Water Pollution Prevention Plan (SWPPP) permit, revisions to the Erosion and Sediment Control ordinance are required. Updates to the ordinance must be in place by August 15, 2008, which is six months after the permit coverage was extended to the City by the Minnesota Pollution Control Agency (MPCA). DISCUSSION The revisions to the Erosion and Sediment Control ordinance focus on the following: · Bringing the ordinance into compliance with current standards and regulations; · Incorporating the MS4/SWPPP requirements; · Revising and clarifying the enforcement process for staff and applicants; · Enhancing the enforcement tools for the City; and, · Integrating the Ordinances into the City Code as Chapter 15. The revised ordinance is designed to be clearer, easier to find, and easier to enforce with a broader range of tools. The ordinance will allow the City to complete corrective work if the permittee fails to do so and draw on escrow or charge the permittee for all related expenses. Issuing stop work orders, withholding other inspections, and withholding Certificate of Occupancy have also been incorporated into the enforcement section.
