<br />7/9/2008 <br />Page 2 <br /> <br />The RCD has a long-standing program assisting local governments in managing soil erosion and <br />sediment, and they have staff registered/certified in erosion and sediment control inspection. <br />Currently, the RCD has a Joint Powers Agreement with the MPCA to inspect all construction <br />sites greater than one acre in size in Ramsey County. The RCD has worked with most local units <br />of government and regional water management organizations within Ramsey County, such as the <br />Rice Creek Watershed District, to develop and implement erosion and sediment control measures <br />to ensure that land disturbance activities have minimal impacts on our water and storm water <br />conveyance resources. <br /> <br />The current fee schedule includes an erosion control fee; the fee is based on the size of the <br />proposed land disturbance. While adjustments may be needed in 2009, the current fees are <br />anticipated to be sufficient to cover the cost of Ramsey Conservation District's rates. Staffwil] <br />monitor the billing and adjust the fee schedule for 2009 if necessary. Similar to the Land Use <br />Permit application, the permit form will state that all applications may be subject to additional <br />fees for reimbursement of consultant costs associated with filing, reviewing, and processing of <br />application in the form of an escrow to the City. Therefore, if the permit fee is not sufficient in <br />2008, the City will be able to recover the costs. <br /> <br />Staff recommends contracting with the RCD for these services. The RCD staff is experienced <br />and certified in erosion and sediment control and are conveniently located in Arden Hills at the <br />Ramsey County Public Works Building. There would be no additional costs incurred by the <br />City, as their services would be paid for by the permit fees charged to applicants. <br /> <br />RECOMMENDED COUNCIL ACTION <br /> <br />I. Approve Ordinance 2008-009 to Add Chapter 15, Erosion and Sediment Control <br />Ordinance and its Subdivisions to the City Code as Presented in the July 14, 2008, Report <br />to the City Council. <br />2. Approve Publishing a Summary of Ordinance 2008-009 for the Erosion and Sediment <br />Control Ordinance as Permitted by Minnesota State Statute 412.191 Subd. 4. (4/5 Vote <br />Required). <br />3.
