would encompass all of the existing easements. The City Council would review <br />the vacation requests prior to the execution of the Final Plat. <br />The subdivision regulations require all ponding and drainage areas to be included <br />in drainage easements that are dedicated to the City. All of the wetlands on the <br />property will be incorporated into a drainage and utility easement. <br />C. Grading. <br />The applicant had submitted soil boring data and a preliminary grading plan as <br />part of the original application. The grading plan (Attachment C) includes the <br />estimated fill needed for each lot when it is developed. Lots 1 and 2 are estimated <br />to need 250 cubic yards of fill, lot 3 is expected to need 200 cubic yards, and lot 4 <br />is expected to need 420 cubic yards. The fill is primarily needed for soil <br />correction and to bring the basement slab to the property elevation. Grading and <br />filling would not occur until each lot is developed. The City and the RCWD <br />would review individual grading and filling as part of the building permit process. <br />The submitted soil analysis does state that the property has limited suitability for <br />construction. The analysis includes guidelines for future construction on the site <br />to mitigate the effects of the low soil suitability for development. The grading <br />information is essentially unchanged from the first review of the Preliminary Plat. <br />D. Trees and Tree Removal (Section 1140.05 Subd 4 and 1325.055) <br />The applicant has submitted a preliminary tree removal plan indicating possible <br />locations for future tree removal; however, since tree removal will not occur until <br />the lots develop the final tree removal plan will be required to meet the City's <br />Tree Preservation Ordinance. Lots 1 and 2 would require very little if any tree <br />removal because the dry area is, for the most part, treeless. Lots 3 and 4 would <br />require tree removal along the Hamline Avenue right-of-way and into the <br />property for the driveway and dwelling. Depending on the number of significant <br />trees on the site, it is possible that tree replacement will be required. A tree <br />survey will be required prior to the issuance of any building permits. Trees could <br />not be removed from the easements or wetland area without City or RCWD <br />approval. Prior to receiving a building or grading permit, the property owner will <br />be required to submit a tree survey and comply with any ordinances regarding tree <br />preservation that are in place at the time of submittal.
