On the Conditional Use Permit Evaluation Criteria: <br />17. The proposed plan would not have any impact on traffic or parking conditions because <br />the parking lot, entrance, and drive aisles are not proposed to be changed <br />18. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke, <br />dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics <br />19. The proposed plan will not impact drainage because the drainage is not being altered <br />20. The proposed plan will not impact population density because the proposed use is not <br />residential <br />21. The proposed plan is not expected to have a significant impact on visual and land use <br />compatibility with uses and structures on surrounding land or adjoining land values <br />because the use is not changing and the visual impacts of the proposed changes are an <br />improvement to what is existing <br />22. Park dedications are not applicable <br />23. The proposed plan does not conflict with the general purpose and intent of the zoning <br />code or the Comprehensive Development Plan for the City. <br />Notice <br />Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City <br />and mailed to residents within three -hundred fifty (350) feet of the subject property. <br />Public Comments <br />At this time the City has not received any comments from the public regarding this project. <br />Staff Recommendation <br />Staff recommends approval of Planning Case #08-026 for a Conditional Use Permit Amendment <br />at 3751 Lexington Avenue subject to the following eleven conditions: <br />1. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and <br />City Council. <br />2. A Conditional Use Permit Amendment drafted by the City Attorney shall be signed <br />by the applicant, and the property owner, prior to the issuance of any building <br />permits. <br />3. A building permit shall be obtained for all proposed building and site alterations. <br />4.
