He stated <br />that, on a map, there is a street where his building is today. He questioned whether he <br />would need to worry about eminent domain. <br /> <br />Community Development Director Lehnhoff replied that he had conversations with the <br />current tenant, Corporate Express. He stated that these design standards do not mean Mr. <br />Rosher has to change the existing building - These are meant to be only for new <br />development. He added that no businesses need to be concerned about eminent domain. <br /> <br />Mr. Rosher inquired about what would happen if the building were vacant for more than <br />6 months. <br /> <br />Community Development Director Lehnhoff replied that, if he has a conditional use <br />permit that is about to expire, he has an option to reapply for another conditional use <br />permit. <br /> <br />Community Development Director Lehnhoff stated that the PUD Process is a well- <br />established process, and that he does not anticipate it changing. <br /> <br />Commissioner Modesette stated that they had discussed not forcing out any existing <br />business. It would take something major for that to happen. <br /> <br />Commissioner Zimmerman stated that this is just meant to be a guiding plan - What we <br />would like to see at one point. <br /> <br />Mr. Rosher questioned how rezoning would affect property taxes. <br /> <br />Chair Larson replied that that was not something they have knowledge of. He stated that <br />it is the value of the structure that determines the property taxes. <br /> <br />Community Development Director Lehnhoff replied that they are only amending the <br />existing rezoning. <br /> <br />Mr. Rosher questioned if the conditional use would be transferable if he were to sell his <br />building. <br /> <br />Community Development Director Lehnhoff replied that the permit goes with the <br />property, not the owner. <br /> <br />Chair Larson stated that the tenant changing would not matter either. <br /> <br />Community Development Director Lehnhoff stated that he would be happy to sit down <br />with Mr. Rosher, ifhe has any further questions. <br /> <br />Mr. Rob Davidson, President of the Davidson Companies, stated that he and his partner, <br />Stu Knowlan, purchased the former Holiday Inn in April 2008. This was purchased as an <br />empty hotel, and it was pretty run down and not taken care of. He stated that they were <br />
