<br />3. A Site Plan Agreement, drafted by the City Attorney, shall be subject to City <br />Council approval and signed by the property owner prior to any work being <br />done on the site. <br /> <br />4. The applicant shall submit a financial surety in a form acceptable to the City <br />Attorney for 125 percent of the cost of materials and installation of the <br />landscaping plan prior to the City issuing any permits. The City shall retain <br />the financial surety for at least two year after full implementation of the <br />landscaping plan. The financial surety shall only be released upon successful <br />inspection of the landscaping by the City Planner, which shall only occur <br />during the growing season. <br /> <br />5. A temporary fence shall be placed between the construction area and the trees <br />that are to be retained on drawing L200 in Attachment E. The fence shall be <br />subject to City Planner inspection and shall be in place prior to the issuance of <br />any building permits. The fence shall be maintained and shall not be removed <br />without City Planner approval. <br /> <br />6. If any of the retained trees on drawing L200 in Attachment E are removed or <br />damaged by any natural or manmade force prior to Staff's final inspection of <br />the fully implemented landscaping plan, Northwestern College shall replace <br />125 percent of the removed caliper inches of trees. The replacement <br />vegetation shall be subject to City Planner and City Forester review and <br />approval. <br /> <br />7. The plans shall be subject to City Engineer review and approval prior to any <br />site preparation and the execution of the Site Plan Agreement. The applicant <br />shall comply with any conditions set by the City Engineer. <br /> <br />8. A fire apparatus road shall be provided to Nazareth Hall and Riley Hall, <br />subject to the approval of the Fire Marshal and City Planner. <br /> <br />9. The applicant shall verify the location of hydrants on the northeastern side of <br />the structure. <br /> <br />10. The loading dock for Community Life Commons will be properly screened as <br />to not be visible from adjacent properties. Garbage and delivery trucks shall <br />be prohibited to the Community Life Commons between the hours of 6:00 pm <br />and 6:00 am. <br /> <br />11. The loading dock lighting shall not be permitted to be in use when the loading <br />dock is not in use. <br /> <br />12. If sound amplifying equipment is used on the campus green it shall be <br />directed away from neighboring residential properties. Activities on the <br />campus green shall not extend past 9 pm. The City may require additional <br />sound mitigation measures to further reduce or eliminate noise impacts from <br />
