<br />Recommendation <br /> <br />The Planning Commission reviewed Planning Case 09-005 and unanimously recommends <br />approval (5-0) of the Site Plan Review and Variance based on the findings of fact and the <br />submitted plans as amended by the following twenty conditions: <br />1. The applicant shall continue to abide by the conditions of all previous permits and <br />reVIews. <br />2. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and <br />City Council. <br />3. A Site Plan Agreement, drafted by the City Attorney, shall be subject to City Council <br />approval and signed by the property owner prior to any work being done on the site. <br />4. The applicant shall submit a financial surety in a form acceptable to the City Attorney <br />for 125 percent of the cost of materials and installation of the landscaping plan prior <br />to the City issuing any permits. The City shall retain the financial surety for at least <br />two year after full implementation of the landscaping plan. The financial surety shall <br />only be released upon successful inspection of the landscaping by the City Planner, <br />which shall only occur during the growing season. <br />5. A temporary fence shall be placed between the construction area and the trees that are <br />to be retained on drawing L200. The fence shall be subject to City Planner inspection <br />and shall be in place prior to the issuance of any building permits. The fence shall be <br />maintained and shall not be removed without City Planner approval. <br />6. If any of the retained trees on drawing L200 are removed or damaged by any natural <br />or manmade force prior to Staffs final inspection of the fully implemented <br />landscaping plan, Northwestern College shall replace 125 percent of the removed <br />caliper inches of trees. The replacement vegetation shall be subject to City Planner <br />and City Forester review and approval. <br />7. The plans shall be subject to City Engineer review and approval prior to any site <br />preparation and the execution of the Site Plan Agreement. The applicant shall comply <br />with any conditions set by the City Engineer. <br />8. A fire apparatus road shall be provided to Nazareth Hall and Riley Hall, subject to the <br />approval of the Fire Marshal and City Planner. <br />9. The applicant shall verify the location of hydrants on the northeastern side of the <br />structure. <br />10. The loading dock for Community Life Commons shall be properly screened so as to <br />not be visible from adjacent properties. Garbage and delivery trucks shall be <br />prohibited to the Community Life Commons between the hours of 7:00 pm and 7:00 <br />am. <br />11. The loading dock lighting shall not be permitted to be in use when the loading dock is <br />not in use. <br />12. If sound amplifying equipment is used on the campus green it shall be directed away <br />from neighboring residential properties.
