location of the proposed tower appears to have been selected in regard to the intent of the <br />ordinance. <br />The Zoning Code additionally requires that cellular antennas and towers shall not: <br />1. Be nearer to the street than the primary building. <br />2. Be nearer to the rear or side yard setbacks than accessory structures. <br />3. Be nearer to the adjoining property's building area than the principal building. <br />4. Be nearer to the property line than the height of the antenna or tower. <br />Bethel University is an uncommon case as the address (3900 Bethel Drive) technically <br />applies to most of the 191 acre campus and includes over two dozen buildings. However, <br />the following can be observed: <br />1. At its nearest point, the proposed tower would be setback over 200 feet from <br />Bethel Drive. This setback is far greater than that of other campus buildings <br />along Bethel Drive. <br />2. The minimum required rear and side interior setback for accessory structures <br />in the B-1 Zoning District is 10 feet. The proposed tower's setback of 170 feet <br />from the eastern property line (whether rear or side) far exceeds the setback <br />permitted for accessory structures. <br />3. The proposed tower's setback would be greater than any principal buildings <br />located along Bethel Drive. In addition, several buildings on the Bethel <br />University campus are closer to the eastern property line than the proposed <br />tower, including Lissner Hall (approximately 160 feet), Chalberg Residence <br />(approximately 110 feet) and Turnwall Residence (approximately 40 feet). <br />4. The proposed tower is greater than 75 feet, its height, from the nearest <br />property line. <br />C. Number of Antennas or Towers — (Section 1325.09 Subd SB) <br />The Zoning Code does not currently limit the number of antennas or towers on non- <br />residential lots. Review of Bethel University's Master Plan does not include any language <br />restricting the number of antennas or towers on campus. This cellular tower would be the <br />first constructed on campus. <br />D.
