<br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />CONDITIONAL USE PERMIT AMENDMENT <br />PC# CASE NO. 09-010 <br /> <br />1.0 Recitals. <br /> <br />A. The County of Ramsey, a political subdivision of the State of Minnesota <br />("Ramsey County") is the record fee owner of the following described <br />property situated in Ramsey County Minnesota: <br /> <br />The south 1425 feet of the east 1572.47 feet of the southwest <br />quarter of Section 15,Township 30 north, Range 23 west, Ramsey <br />County, Minnesota, Escept the north 810 feet of the east 626 feet <br />thereof. Subject to County State Aid Highway (C.S.A.H.) 96 right of <br />way. <br /> <br />B. On the 22nd Day of May, 2009, Ramsey County submitted a completed <br />Land Use application for a CUP Amendment ("Application"). <br /> <br />F. At a public hearing on July 8, 2009, the Arden Hills Planning Commission <br />reviewed the Application; the report and comments of the Arden Hills staff; <br />the reports and comments submitted by Ramsey County and its <br />representatives; the comments of members of the public; and <br />recommended approval of a CUP Amendment for Planning Case 09-010 <br />subject to certain conditions. <br /> <br />2.0 Approval of Conditional Use Permit Amendment. On the 13th Day of July, <br />2009, the Arden Hills City Council; <br /> <br />A. Reviewed the Application, the recommendations of the Arden Hills <br />Planning Commission, the reports and comments of the Arden Hills staff, <br />the comments Ramsey County, and the comments of members of the <br />public who chose to speak. <br /> <br />B. Considered the effects of the proposed use of the Property upon the <br />health, safety, convenience and general welfare of the owners and <br />occupants of the surrounding land, in particular, and of the community as <br />a whole, in general, including but not limited to the following factors: <br />existing and anticipated traffic and parking conditions; noise, glare, odors, <br />vibrations, smoke, dust, air pollution, heat, liquid or solid waste, and other <br />nuisance characteristics; drainage; population density; visual and land use <br />compatibility with uses and structures on surrounding land; park <br />dedications where applicable, and the orderly development of the <br />
