ARDEN HILLS CITY COUNCIL—May 11, 2009 20 <br /> Councilmember Holmes stated that once a violation has been issued the remaining <br /> l tenants would know to watch. <br /> Community Development Director Lehnhoff stated that two violations would be <br /> consistent with the City's recently adopted compliance policy and it is up to <br /> Wellington Management to monitor this. <br /> Councilmember Holden stated that two violations would be acceptable. <br /> The motion to add Recommendation 8 was called to a vote. The motion carried (4- <br /> 1; Councilmember McClung). <br /> The motion to approve Planning Case 09-007 with the approved amendments was <br /> called to a vote. The motion carried (3-2; Mayor Harpstead, Councilmember <br /> McClung). <br /> E1. Motion Regarding the Acceptance of RRLD's Termination of the <br /> PDA <br /> E2. Motion Regarding Authorizing the Delivery of a Notice of <br /> Rescission Under the OTP to the GSA <br /> E3. Discussion of Plans and Future Schedules Regarding TCAAP <br /> City Administrator Ron Moorse stated the City has in place an Offer to Purchase <br /> (OTP) with the US General Service Administration (GSA) for a portion of the Twin <br /> Cities Army Ammunition Plant (TCAAP) property and a Preliminary Development <br /> Agreement (PDA) with RRLD. RRLD has notified the City of the intention to <br /> terminate their agreement to acquire and redevelop a portion of TCAAP. The <br /> developer filed its notice to terminate because it determined that the project has <br /> become economically infeasible. The letter also requests the City forward to GSA a <br /> notice of rescission of the OTP. <br /> MOTION: Mayor Harpstead moved and Councilmember Grant seconded a <br /> motion to Accept the May 12, 2009 RRLD Termination of the PDA <br /> subj ect to receipt of a signed executed copy. The motion carried <br /> unanimously (5-0). <br /> MOTION: Mayor Harpstead moved and Councilmember Grant seconded a <br /> motion to authorize Staff to Delivery a Notice of Rescission under the <br /> OTP to the GSA subject to obtaining an executed copy of RRLD's <br /> letter dated May 12, 2009. <br />
