6. The property owner is working with Staff to bring the parking lot and landscaping into compliance with the original CUP. 7. The terms of the original CUP would continue to apply with the exception of Condition 4.7, which will be amended with approval of this planning case. On the Conditional Use Permit Amendment/Site Plan Review: 8. The requested amendment would not increase the number of vehicles operating out of this facility, therefore it is not anticipated that the amendment would have any impact on existing traffic and parking conditions; however, traffic and parking were concerns raised by residents in regards to this application. 9. Noise, air pollution, and odors have been concerns raised by residents in regards to this application. First Student is not requesting an increase in the total number of vehicles currently located on site; however diesel powered buses would produce more noise and odors than gas powered vans. 10. It is not anticipated that the proposed amendment would have any impact on any additional levels of permanent glare, vibration, smoke, dust, air pollution, heat, liquid, or solid waste. 11. The requested amendment will not alter drainage patterns. 12. The requested amendment is not expected to have any impacts on population density. 13. The park dedication fee is not applicable to this application. 14. Approving this amendment does not conflict with the City's Comprehensive Plan or the intent of the Zoning Code Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within three -hundred fifty (350) feet of the subject property. Resident Comments Staff has received two calls from residents in regards to this planning case. Concerns raised were increased noise, air pollution, and fumes from the diesel buses; increased traffic along Lake Valentine Road; and a concern about potential future expansion of the bus terminal to the east. Staff Recommendation The findings of fact in this planning case do not clearly support a recommendation to approve or deny. While the actual number of buses operating out of the facility is not proposed to increase as a result of this request, and therefore would not increase the existing impacts of the use, the function of allowing additional buses in lieu of vans does have an impact on noise and fumes.
