6. The property owner is working with Staff to bring the parking lot and landscaping into <br />compliance with the original CUP. <br />7. The terms of the original CUP would continue to apply with the exception of Condition <br />4.7, which will be amended with approval of this planning case. <br />On the Conditional Use Permit Amendment/Site Plan Review: <br />8. The requested amendment would not increase the number of vehicles operating out of <br />this facility, therefore it is not anticipated that the amendment would have any impact on <br />existing traffic and parking conditions; however, traffic and parking were concerns raised <br />by residents in regards to this application. <br />9. Noise, air pollution, and odors have been concerns raised by residents in regards to this <br />application. First Student is not requesting an increase in the total number of vehicles <br />currently located on site; however diesel powered buses would produce more noise and <br />odors than gas powered vans. <br />10. It is not anticipated that the proposed amendment would have any impact on any <br />additional levels of permanent glare, vibration, smoke, dust, air pollution, heat, liquid, or <br />solid waste. <br />11. The requested amendment will not alter drainage patterns. <br />12. The requested amendment is not expected to have any impacts on population density. <br />13. The park dedication fee is not applicable to this application. <br />14. Approving this amendment does not conflict with the City's Comprehensive Plan or the <br />intent of the Zoning Code <br />Notice <br />Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City <br />and mailed to residents within three -hundred fifty (350) feet of the subject property. <br />Resident Comments <br />Staff has received two calls from residents in regards to this planning case. Concerns raised <br />were increased noise, air pollution, and fumes from the diesel buses; increased traffic along Lake <br />Valentine Road; and a concern about potential future expansion of the bus terminal to the east. <br />Staff Recommendation <br />The findings of fact in this planning case do not clearly support a recommendation to approve or <br />deny.
