Motion to Approve Ordinance 2009-011 and Ordinance 2009-012 (continued) <br /> consumption law then the business would have a lesser penalty than if they had not <br /> opted for the annual training for their staff. <br /> Councilmember Holmes asked how the fines would be defined and how these <br /> were going to be implemented. <br /> City Planner Beekman stated that Attachment C outlines this for the Council. <br /> Mayor Harpstead asked what the cost for server training was. <br /> City Planner Beekman stated that the amount would range depending on whom <br /> the establishment hired to provide the training and she did not have these figures at <br /> this time. <br /> Councilmember Holden stated that there were no fines for the server violating the <br /> minor consumption law. <br /> City Planner Beekman stated that the server would be in violation of State law and <br /> the State has penalties that go along with the violation. The fines outlined in the <br /> proposal were for the establishment itself not the server. <br /> Councilmember Holden asked why the City does not have a first violation against <br /> a server as well. <br /> City Planner Beekman clarified that the City would not levy any penalties against <br /> the server based on this proposal, only the establishment. The server would be <br /> subject to any criminal charges. - <br /> Councilmember Grant stated that there were no fines listed for the first offense for <br /> those businesses that had server training. He asked if this was correct. <br /> Mayor Harpstead stated that the intention for this was to encourage businesses to <br /> provide server training by minimizing any potential fines. <br /> Councilmember Holden asked if there was a hurry in passing these ordinances <br /> because there were several unanswered questions including the cost of server <br /> training in comparison to the fines. <br /> Mayor Harpstead stated that he had concerns that in the process of eliminating <br /> things Staff had eliminated some layering of regulations.
