Motion to Approve Ordinance 2009-011 and Ordinance 2009-012 (continued) <br /> City Attorney Filla stated that he would guess that they would carry insurance to a <br /> greater extent than what City Code currently requires. <br /> Councilmember Holmes clarified that it is only assumed that the business carries <br /> more liability insurance than the minimum. She asked if the two tiered system <br /> would be necessary then. <br /> City Attorney Filla stated that this was a choice that the Council can make. It was <br /> inserted to encourage people to have training for their staff. <br /> Mayor Harpstead stated that this question would depend on the cost of the training <br /> and if it was beneficial <br /> Councilmember Holmes stated that if their insurance is higher than the minimum <br /> then it would not matter. <br /> Councilmember Holden stated that the Council can only assume that they have the <br /> coverage. <br /> Mayor Harpstead stated that if the benefit was there then it would be an incentive <br /> for businesses to provide server training. <br /> Councilmember Holden asked if server training was done annually. <br /> City Planner Beekman stated that this was correct. <br /> Mayor Harpstead stated that the overlap of gambling license and liquor license <br /> was crossed out. There are establishments in Arden Hills that have charitable <br /> gambling. He asked that Staff take another look at the deletion of these types of <br /> clauses to see if there is a way to be clear about the City having to grant both <br /> licenses. <br /> City Attorney Filla stated that the State law says that a person can not gamble in <br /> an establishment that has a liquor license issued to them. Charitable gambling is <br /> excluded from this. <br /> Councilmember Grant stated that he would favor a fine with the warning letter for <br /> the first violation with minor consumption with server training. He stated that the <br /> fifth violation states that it shall be loss of license. He asked if Council would like <br />
