ARDEN HILLS CITY COUNCIL—September 28, 2009 15 <br /> 7B. Motion to Approve Ordinance 2009-011 and Ordinance 2009-012 (continued) <br /> to make it clear that there is a level beyond the fourth violation in the fee schedule, <br /> even though there is no fee attached. <br /> Mayor Harpstead clarified that Councilman Grant wanted a fee with the fifth <br /> violation. <br /> Councilmember Grant stated that the fee schedule should state that the fifth <br /> violation could state that it would be the maximum fine and loss of license. <br /> Mayor Harpstead asked what the length of time was that violations had to occur in <br /> to meet the number of violations on the fee schedule. <br /> City Planner Beekman stated that the number of violations was based on a 36 <br /> month time period. <br /> Councilmember Grant clarified that this was a rolling 36 months. <br /> City Attorney Filla stated that the 36 months was an arbitrary number and the <br /> Council could change this. - <br /> Mayor Harpstead asked if the City had a lot of notice of violations. <br /> City Attorney Filla stated that Arden Hills does not. The Sheriff does routine <br /> compliance checks and in the last five years Arden Hills has had maybe three <br /> violations. <br /> Mayor Harpstead stated that he would be interested in making the number of <br /> violations less than four or five before the Council looked at revoking the <br /> establishment's license. <br /> Councilmember Grant asked if the number of violations could be less before the <br /> Council looked into revoking a license. <br /> Mayor Harpstead stated that this was something that Staff could consider. <br /> Councilmember Grant stated that he would like to see it changed to 48 months. <br /> Mayor Harpstead asked if there was an appeal process involved with revoking a <br /> license. <br />
