ARDEN HILLS CITY COUNCIL TCAAP WORK SESSION-OCTOBER 12, 2009 4 <br /> IB. TCAAP Reimbursables — Direction for Moving Toward Resolution <br /> (cont.) <br /> City Administrator Moorse indicated if both parties were not agreeable to any <br /> certain terms that the next step would be mediation. He noted the expense of <br /> mediation would be roughly $5,000 for each party. <br /> City Administrator Moorse explained that it may be possible to reach a resolution <br /> at $75,000. <br /> Councilmember Holden suggested the City offer $53,000 to Ryan Companies as <br /> this was the middle ground. <br /> The Council agreed to proceed with the $53,000 number and to discuss the <br /> reimbursables further at the next meeting if there was not an agreement as the <br /> Council may have to pursue mediation. <br /> C. Concurrent Jurisdiction <br /> City Administrator Moorse presented the City Council with information on <br /> concurrent jurisdiction on the TCAAP property. He explained that some criminal <br /> activity has taken place on the TCAAP site, which at this time was federal land. In <br /> order to prosecute the offenders, it would need to happen at a federal level. It was <br /> suggested by the Army that the City have concurrent jurisdiction specifically for <br /> these types of offenses to prosecute offenders at a local level. <br /> Councilmember Grant stated he felt this would be a rare occurrence and that if <br /> the City was not able to police the site, they should stay off of the TCAAP site and <br /> let the Army handle their own security. Councilmember Holmes agreed. <br /> Discussion ensued regarding the fire protection on the TCAAP site. The Council <br /> asked that this be investigated further. <br /> It was the consensus of the Council to direct staff to follow up with the Sheriff and <br /> the Army, explaining to them the City was not interested in concurrent jurisdiction <br /> over the TCAAP site. <br />
