The existing lot is 2.76 acres. The applicant is proposing to subdivide it into two lots. Lot 1 <br />will consist of the housing development and is proposed to be rezoned to R-4 from I-1. In <br />support of the rezoning, the applicant is requesting a Comprehensive Plan amendment for <br />this lot to change its future land use designation from "Utility" to "Multiple Family." Lot 2 <br />will consist of the communications tower and equipment building. This lot would remain in <br />its current zoning district and land use designation. The use of this lot will be limited to the <br />existing tower through the development agreement. For the purposes of calculating <br />landscaping and density, the two lots are considered as one. <br />Lot 2 exceeds the minimum landscape requirements for the I-1 District which are 35 percent. <br />Lot 1 is proposed to have 53 percent landscaping plus an additional 6 percent pervious paver <br />coverage. City Code requires 65 percent landscaping for residential districts. Together the <br />two lots would have 58 percent landscaping plus 6 percent pervious pavers for a total <br />pervious area of 64 percent. The Zoning Code does not directly address the use of pervious <br />pavers, but pervious pavers do help drainage on the site and the use of green materials is <br />encouraged. <br />B. Building Height and Density — Flexibility requested <br />The maximum building height in the R-4 District is 35 feet. The maximum density is 12 <br />units per acre. The proposed building would be four -stories and 54 feet four inches tall, and <br />have a density of just under 20 units per acre. The location of this site amongst office uses <br />and adjacent to Highway 694 makes it a suitable location for a higher intensity of use. <br />Functionally, the site is more similar to the B-2 District, which allows residential up to 20 <br />units per acre and 50 feet in height along with office, commercial, and light industrial. <br />C. Setbacks — Meets Requirements <br />The minimum building setbacks in the R-4 District are 40 feet in the front yard, 30 feet in the <br />rear yard, and five feet in the side yard, with both sides adding up to 15 feet. The proposed <br />buildings meet the minimum requirements for the building setbacks. <br />The minimum parking setbacks in the R-4 District are 20 feet from any right-of-way and five <br />feet from any side or rear property line.
