than other lots in the area, make siting a conforming new home extremely difficult. If all setback <br />requirements were met the home and garage would need to be constructed within a 49 foot wide <br />by 40 foot deep area. The existing home currently encroaches within both side setbacks. It <br />might be possible for the applicants to construct a home within the front and lakeshore setbacks; <br />though it could be as tall as 35 feet. <br />The prevailing character of the neighborhood is of one and a half to two-story homes constructed <br />in the 1950's. However, two homes have more recently been redeveloped, and given the high <br />value of the land it is likely that the City will see similar variance requests in this neighborhood. <br />Additionally, given that one of the homes is located as near as 66 feet from the OHW level, as <br />homes redevelop it is likely that they will be constructed nearer to the lake then they currently <br />exist. A recommendation for approval or denial will need to be accompanied by a finding on <br />whether the proposed home would alter the essential character of the community. <br />If the Planning Commission recommends approval of the variance, Staff recommends the <br />following four conditions: <br />1. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission. <br />2. Building, Grading and Erosion Control, and Demolition permits shall be obtained by <br />the property owner. <br />3. The structure shall conform to all other regulations in the City Code. <br />4. The applicant shall obtain approval or a waiver from the Rice Creek Watershed <br />District prior to the issuance of any building permits. <br />Options <br />The findings in this report are not specific enough to fully support approval or denial of the <br />variance. With a motion to approve or deny, the findings or the reasons for the motion must be <br />stated. The following three criteria must be addressed: <br />® The proposed home will/will not alter the essential character of the neighborhood or the <br />City because... <br />Once the findings are stated, a full motion to approve or deny can be made. If there is a motion <br />to table, it is not necessary to state the findings. <br />1.
