If you believe you have <br />valid grounds for challenging the survey, retain a reputable surveyor and provide my office with a <br />verified copy of the resulting survey. Under no circumstances are you to disturb survey markers. If the <br />second survey is not consistent with the present survey, we will be happy to discuss any discrepancy. <br />Otherwise, we will assume that the matter has been settled and the boundary lines fixed. <br />You mention "adverse possession." This claim is only possible where use of property has been adverse to <br />the rights and demands of the owners. obviously, the previous owner permitted you to mow grass on her <br />property. You have no grounds to claim adverse possession.. <br />The Maloneys have acted responsibly. They initially asked you about the lot lines because they wished to <br />put in a fence to deter children from running through their garden, and did not want encroach on your <br />property inadvertently. After receiving several unpleasant and rather threatening communications from <br />you, they retained a surveyor to locate the actual boundaries. The City of Arden Hills issued a building <br />permit based upon the lot line established by that survey. If you have survey evidence supporting your <br />opinion as to the boundary line, present it to me by July 1, 2009.
