We are doing the best we can <br />to comply with your deadline of July 1st. <br />When we bought our house in March, 1992, the owners of the house that the <br />Maloneys now own told us where the boundary line was between our lots. We <br />went by their explanation. We have cut the grass and fertilized and maintained <br />the lawn on that basis since that time. We also moved the light green colored <br />bush from the front of our house to the back east end of the property on the basis <br />of this information from them. <br />We do believe that we have acquired title to the strip of land between our <br />properties that we have been mowing and maintaining for over 17 years and <br />appears to be in dispute, based on adverse possession. We have treated this <br />strip of land in a manner consistent with ownership. This strip of land in question <br />appears to be roughly no more than 2 — 3 feet wide or long for the length or width <br />Of our adjoining property line. <br />We have tried to work with the Maloneys. If one of our neighbors had strong <br />reasons against us building a fence, we would not build one. You mention. in your <br />letter that they want to build a fence to deter children from running through their <br />garden. This garden must be in an area of their property that we cannot see. As <br />we said to the Maloneys in June, 2007, we will talk to the neighborhood students <br />and -tell them not to walk through our yards, as a favor to the Maloneys. Since <br />that time, we have- to-ld students not to walk through our yards. They-, were very <br />respectful and readily agreed to respect our request. We don't have a problem <br />with students walking through our yard. We just made the request to honor the <br />desires of the Maloneys. We have not seen any students or children walking or <br />running through our yard or their yard or garden. <br />We were also surprised when Mr. Maloney told us he was secretly videotaping <br />children and students walking through their yard. <br />We thought the Maloneys had agreed to not to build a fence and we confirmed <br />that in a letter to the Maloneys. We simply believe that a fence will result in a <br />significant decline in the value of our home. <br />
