2 <br />We request that we get together with the Maloneys to understand what is actually <br />motivating them to revisit this fence issue. There are probably multiple mutually <br />beneficial solutions to this matter if people can get together and talk in a <br />respectful manner. For the first time, both of our children will be in college this <br />fall. If and when the residential real estate market comes back, we are leaning <br />toward selling our house. A mutually beneficial solution to the issues involved <br />here is what we have always hoped for from the Maloneys. <br />If the Maloney's refuse to get together with us or insist on continuing to proceed <br />with building a fence, we will meet with an experienced real estate litigator to get <br />advice on our rights in this matter. Gregg has a law degree, but has not practiced <br />since the 1980s. If the Maloney's agree not to build a fence or we are able to <br />reach a mutually agreeable solution with the Maloney's, we are open to <br />discussing the prospect of not taking the steps necessary to fully understand our <br />rights on this matter. <br />It is too bad that the Maloney's did not buy a home that backed up to woods so <br />they would not have to deal with people, neighbors or students attending the high <br />school or the elementary school just a few blocks from their home. They could <br />have asked us how we would have felt about a fence before they bought their <br />home. The "park like" setting between our properties is what attracted us to our <br />home and these aesthetics are what gives our property value and what visitors <br />are most impressed with.
