EN HILLS <br />MEMORANDUM <br />DATE: January 25, 2010 <br />TO: Mayor & City Council <br />FROM: Meagan Beekman, City Planner <br />SUBJECT: PC #10-001 <br />Easement Vacation <br />Arden Plaza <br />3585 Lexington Avenue North <br />Back�round <br />On July 13, 2009, the City Council approved Planning Case 09-011 for a Master Planned Unit <br />Development (PUD), Preliminary and Final Plat, and Final PUD for Phase I of the Arden Plaza <br />Redevelopment proposal. In the process of �ling the Final Plat Ramsey County informed the <br />developer that there was an issue with one of the existing easements located on the property. <br />The easement, as recorded with Ramsey County, describes an area that runs east-west along the <br />northern portion of the Arden Plaza property. The easement is described as an Underground <br />Electric Utility Easement and Pedestrian and Bicycle Way Easement. <br />Minnesota Statute only allows drainage and utility easements to be recorded with a final plat. <br />Easements for road or pedestrian ways are required to be dedicated as right of way. Since the <br />easement in question is in part a pedestrian and bicycle way easement it is technically an <br />easement for public way, the land affected by the easement would then need to be dedicated as a <br />public way on the plat. <br />The proposed site plan is situated such that dedicating this land as a public way would be a <br />hindrance to the proposed development. The southerly line of the easement, especially the <br />portion that juts to the south to go around the electric transformer box lies within the area that <br />has been designed as the northerly drive isle around the proposed building to the drive up <br />window, a retaining wall, and a stairway to the path along County Road E.
