If the homeowner wanted a larger home then they would need to meet the <br /> fifty foot setback. <br /> Commissioner Thompson asked for clarification regarding the removal of <br /> vegetation. <br /> City Planner Beekman explained that trimming of vegetation was permitted but <br /> clear cutting was not. If the soil is exposed then erosion control measures would <br /> need to be taken as long as the soil is exposed. This is further explained in <br /> Chapter 15 of the City Code regarding grading and erosion. <br /> Commissioner Holewa asked if this planning case were approved if it would go to <br /> the City Council for approval_ <br /> City Planner Beekman explained due to the complexity of the planning case the <br /> City Council will be reviewing it at a work session before approving it. If a <br /> recommendation is made by the Planning Commission the City Council will <br /> review the planning case at their February 16 work session and depending on this <br /> meeting could go to the City Council for a vote at their February 22, 2010, <br /> meeting. <br /> Chair Larson opened the public hearing at 7:12 p.m. <br /> Chair Larson invited anyone for or against the application to come forward and <br /> make comment. <br /> Mr. Mark Johnson, 3124 Hamline Avenue N, Arden Hills, expressed concerns <br /> about the setback towards the lake. He stated that the language including the <br /> "minus ten feet" allowed homes to move closer to the lake. This would have an <br /> adverse effect on other property owners and their sight lines. <br /> Mr. Steve Nelson, 3475 Siems Court, Arden Hills, stated concerns that the front <br /> and side setbacks are not being addressed by the regulations. He also stated that <br /> grade changes that are created by bringing in additional fill are not addressed by <br /> the regulations. <br /> Ms. Ann Stanton, trustee to the property at 1569 Edgewater Avenue, stated she <br /> supports the setbacks but does not agree with the "minus ten feet" language. This <br /> would reduce the setbacks even more. She stated that this amendment would <br /> adversely affect the lakeshore owners. She clarified that she supports the initial <br /> efforts that the City made in closing a loophole for new homes and additions. <br /> Changing the code will change the setback. <br /> Michael Mergens, Larkin Hoffman, representing Mr. and Mrs. Bauer at 1563 <br /> Edgewater, presented the Commission with a visual that illustrated the"creeping" <br /> of homes toward the fifty foot setback using the"minus ten feet" language that is <br />
