City Planner Beekman stated that this was the public hearing and the City Council would not be having another one. Commissioner Holewa pointed out that during the discussions on the Comprehensive Plan it was noted that Arden Hills is an aging community. As people get older they have less money and may not be able to rebuild their homes closer to the lake as the homes surrounding them do. He stated this would not be fair to the homeowner who did not have the resources to build closer to the lake. Chair Larson stated that the regulations are being reviewed and updated in order to clarify points. Commissioner Modesette pointed out that no matter what the regulations will not satisfy everyone. Commissioner Zimmerman moved seconded bv Commissioner Holewa to recommend approval of Planning Case 09-003 to amend Sections 1305.04 1325.07 and 1330 of the Zonine Code re ardin the Ci 's Shoreland Re ulations as presented in the February 3 2010 Planninp,Case Report with the revisions recommended by Staff and the removal of the phrase "minus 10 feet" in Section 1330.03,Subd.4, at the end of the first sentence. Commissioner Holewa moved to add language that the auxiliary structure can not be used to store water crafts and it can not be wider than ten feet as viewed from the lake. The motion failed due to lack of a second. The original motion was called to a vote. The motion failed Ayes—Commissioners Holewa, Zimmerman,Thompson Mays—Chair Larson, Commissioners Reiff, Modesette Commissioner Reiff moved seconded bv Commissioner Modesette to recommend approval of Planning Case 09-003 to amend Sections 1305.04, 1325.07 and 1330 of the Zonint. Code regarding the City's Shoreland Re ulations as presented in the February 3 2010 Plannin,g Case Report with the revisions recommended by Staff. Commissioner Holewa stated the motion is out of order because it is the same as the motion that was just voted on. Chair Larson ruled that the motion was different and could be voted on by the Planning Commission. The motion was called to a vote.
