boatlifts are now specifically mentioned as having no restrictions in terms of setbacks to <br /> the lake. Additionally,patios, stairways, access lifts, landings, fences, and one accessory <br /> storage shed are now permitted within the structure setback to the lake under certain <br /> circumstances. <br /> a. Patios—A regulation permitting uncovered patios within the structure setback to <br /> the lake, under certain circumstances, has been added to the regulations. The <br /> patios must be uncovered, located at grade, and remain outside of the Shore <br /> Impact Zone. <br /> b. Stairway landings—The proposed ordinance limits the square feet of landings <br /> within the Shore Impact Zone to 40 feet. <br /> c. Storage sheds—The proposed ordinance permits one accessory storage shed <br /> within the structure setback to the lake provided that it is not located within the <br /> shore impact zone (25 feet on Lake Johanna) and does not exceed 64 square feet <br /> in size or eight feet in height. The structures can be connected to electricity and <br /> lighting is permitted. Separate regulations within the Code limit glare as a <br /> nuisance. <br /> 4. Dock setbacks—The proposed regulations include a five foot setback for dock placement - <br /> at the shoreline. There is also an added provision that would allow the Zoning <br /> Administer to alter this regulation if topography or lot width created a significant <br /> limitation on dock placement on a particular lot. <br /> 5. Mitigation—A mitigation plan similar to the one used by Shoreview has been added in <br /> place of the permeable surface credit that was proposed previously by Staff. The new <br /> language would require all properties seeking special approval from the City through a <br /> variance or conditional use permit to provide a mitigation plan to the City. The <br /> mitigation plan would also be required if a property wanted to increase the impervious <br /> coverage by up to five percent with a pervious hard surface. <br /> Performance Standards (Attachment Q <br /> Section 1325.07 included regulations on lakefront lots; however, that section has been removed <br /> from Section 1325 and reincorporated into Section 1330.
