6. The applicant shall submit a financial surety in the amount of 125 percent of the cost <br />of the landscaping and trailway improvements prior to the issuance of any building <br />permits. <br />7. The applicant shall obtain approval from the Rice Creek Watershed District and all <br />other applicable permitting agencies prior to the issuance of any permits. Copies of <br />such permits shall be provided to the City prior to the issuance of any permits. <br />8. The plans shall be subject to Fire Marshal approval before building permits are <br />issued. <br />9. Final grading, drainage, and utility plans shall be subject to approval by the Public <br />Works Director and City Engineer prior to the issuance of any building permits. <br />10. The existing tower shall be brought into compliance with Conditional Use Permit 72- <br />024 or an amended CUP prior to the issuance of any building permits. <br />11. An updated structural analysis report, indicating that the tower is structurally sound, <br />shall be conducted and submitted to the City prior to the issuance of any building <br />permits to confirm compliance with the Conditional Use Permit and City regulations. <br />12. The applicant shall construct approximately 1,680 feet of trail along the south side of <br />County Road F, which will connect their property with Lexington Avenue. The trail <br />sha11 be eight feet in width with a four foot boulevard. The width of the trail and/or <br />boulevard may be reduced in areas for topographic reasons, subj ect to the approval of <br />the City Engineer and Ramsey County. <br />13. The applicant shall provide the required number of ADA parking spaces. The ADA <br />parking space locations shall be subject to Building Official approval. <br />14. The applicant shall install an additional five trees between County Road F and the <br />development. <br />15. Lot 2 shall be limited in use to a communications tower and related equipment. If the <br />communications tower is abandoned, the lot shall not be redeveloped as a new use but <br />may be recombined with Lot 1. <br />Req uested Action <br />While all four motions are contingent on one another they must be made separately. <br />1. Motion to approve Planning Case 09-021 for a Conditional Use Permit Amendment at <br />1296 County Road F based on the Findings of Fact in the March 8, 2010, Planning Case <br />Repor�. <br />2.
